JAKARTA, JURNAL TIPIKOR – Sekretaris Jenderal DPP PDI Perjuangan Hasto Kristiyanto hari ini menegaskan di Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta bahwa tidak ditemukannya tersangka Harun Masiku hingga saat ini bukan merupakan kesalahannya.
Hasto menyampaikan hal ini saat membacakan duplik atau tanggapan terhadap replik dalam persidangan.
Menurut Hasto, keterangan dari pimpinan dan penyelidik Komisi Pemberantasan Korupsi (KPK), Arief Budi Rahardjo, yang menyatakan bahwa lokasi Harun Masiku sudah diketahui namun tidak ditangkap, sepenuhnya merupakan tanggung jawab KPK.
“Di persidangan ini, saya sudah meminta agar Harun Masiku segera ditangkap sehingga proses hukum ini menjadi lebih fair dan berkeadilan,” ujar Hasto.
Dalam nota pembelaannya (pledoi), Hasto menjelaskan secara berlapis bahwa dirinya tidak terbukti melakukan perintangan penyidikan atau obstruction of justice.

Penjelasan tersebut mencakup dalil Pasal 21 sebagai delik materiel serta asas lex scripta, lex certa, dan lex previa dalam hukum pidana yang tidak memungkinkan adanya makna ekstensif sehingga penyelidikan tidak termasuk dalam ruang lingkup Pasal 21 Undang-Undang (UU) tentang Pemberantasan Tindak Pidana Korupsi.
Selain itu, ia juga menyoroti norma baru melalui Sertifikasi Konvensi Perserikatan Bangsa-Bangsa Anti Korupsi (UNCAC) melalui UU Nomor 7 tahun 2006.
Hasto juga membantah tuduhan bahwa ia memerintahkan Harun Masiku untuk merendam telepon genggam dan bersiaga di Kantor DPP PDI Perjuangan melalui penjaga Rumah Aspirasi, Nur Hasan.
“Di dalam pledoi sudah dijelaskan dengan delapan dalil analisa fakta hukum sebagaimana pleidoi penasihat hukum terdakwa,” tambahnya.

Sebelumnya, Hasto dituntut pidana 7 tahun penjara dan denda Rp600 juta subsider 6 bulan kurungan dalam kasus dugaan perintangan penyidikan dan suap.
Ia didakwa menghalangi penyidikan perkara korupsi yang menyeret Harun Masiku sebagai tersangka dalam rentang waktu 2019–2024.
Hasto diduga menghalangi penyidikan dengan memerintahkan Harun, melalui Nur Hasan, untuk merendam telepon genggam Harun ke dalam air setelah operasi tangkap tangan KPK terhadap anggota Komisi Pemilihan Umum (KPU) periode 2017–2022 Wahyu Setiawan.
Ia juga dituduh memerintahkan ajudannya, Kusnadi, untuk menenggelamkan telepon genggam sebagai antisipasi upaya paksa penyidik KPK.

Selain itu, Hasto didakwa bersama-sama dengan advokat Donny Tri Istiqomah, mantan terpidana kasus Harun Masiku Saeful Bahri, dan Harun Masiku, memberikan uang sejumlah 57.350 dolar Singapura atau setara Rp600 juta kepada Wahyu pada rentang waktu 2019–2020.
Uang tersebut diduga diberikan agar Wahyu mengupayakan KPU menyetujui permohonan pengganti antarwaktu (PAW) calon anggota legislatif terpilih dari Daerah Pemilihan Sumatera Selatan I atas nama Riezky Aprilia kepada Harun Masiku.
Atas dakwaan tersebut, Hasto terancam pidana yang diatur dalam Pasal 21 dan Pasal 5 ayat (1) huruf a atau Pasal 13 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dan ditambah dengan Undang-Undang Nomor 20 Tahun 2001 juncto Pasal 65 ayat (1) dan Pasal 55 ayat (1) ke-1 jo. Pasal 64 ayat (1) KUHP.
