JAKARTA, JURNAL TIPIKOR – Kejaksaan Agung (Kejagung) akan segera menyerahkan sejumlah aset sitaan dari terpidana kasus dugaan korupsi tata niaga timah, Harvey Moeis, dan aset terkait milik istrinya, Sandra Dewi, kepada Badan Pemulihan Aset (BPA) Kejagung.
Penyerahan ini bertujuan agar aset-aset tersebut dapat segera dilelang.
Kepala Pusat Penerangan Hukum (Kapuspenkum) Kejagung,
Anang Supriatna, menyatakan bahwa aset yang telah disita dan memiliki kekuatan hukum tetap untuk dirampas bagi negara akan diserahkan oleh tim Jaksa Penuntut Umum (JPU) eksekutor kepada BPA.
“Aset yang sudah disita dan sudah berkekuatan hukum dirampas untuk negara dan diperhitungkan sebagai uang pengganti, akan diserahkan oleh tim JPU eksekutor kepada BPA,” kata Anang Supriatna di Jakarta, Senin (3/10).

Setelah diserahkan, aset akan dihitung nilainya oleh BPA, dan kemudian akan dilanjutkan dengan proses lelang.
Hasil lelang akan diperhitungkan sebagai bagian dari pemulihan kerugian negara dalam kasus korupsi timah yang merugikan negara triliunan rupiah.
Pencabutan Gugatan Keberatan Aset oleh Sandra Dewi
Langkah penyerahan aset ini menyusul keputusan Sandra Dewi yang sebelumnya telah mencabut gugatan keberatan penyitaan asetnya yang terkait dengan kasus korupsi pengelolaan tata niaga komoditas timah di wilayah izin usaha pertambangan (IUP) PT Timah pada tahun 2015-2022.
Majelis Hakim Pengadilan Negeri Jakarta Pusat telah menerima dan mengabulkan permohonan pencabutan tersebut, yang secara otomatis mengakhiri persidangan permohonan keberatan yang diajukan oleh Sandra Dewi, Kartika Dewi, dan Raymond Gunawan.

Beberapa aset yang sebelumnya dimohonkan keberatan oleh Sandra Dewi meliputi:
- Sejumlah perhiasan.
- Dua unit kondominium di perumahan Gading Serpong, Tangerang, Banten.
- Rumah di perumahan Pakubuwono, Kebayoran Baru, Jakarta.
- Rumah di Permata Regency, Jakarta.
- Tabungan di bank yang diblokir.
- Sejumlah tas mewah.
Adapun dalih Sandra Dewi dalam keberatan tersebut adalah posisinya sebagai pihak ketiga yang beriktikad baik, dan aset diperoleh secara sah melalui endorsement atau iklan, pembelian pribadi, hadiah, tidak terkait dengan tindak pidana korupsi, serta adanya perjanjian pisah harta sebelum menikah.
Vonis Inkracht Harvey Moeis
Sementara itu, Mahkamah Agung (MA) telah menolak permohonan kasasi Harvey Moeis—yang merupakan perpanjangan tangan PT Refined Bangka Tin (RBT) dalam kasus korupsi timah—sehingga vonis 20 tahun penjara yang dijatuhkan kepadanya telah berkekuatan hukum tetap (inkracht). Saat ini, Harvey Moeis tengah menjalani masa hukumannya di Lapas Cibinong,
Kabupaten Bogor, Jawa Barat.
Penyerahan aset sitaan ini merupakan bagian dari komitmen Kejagung untuk mengoptimalkan pemulihan aset negara dan memberikan efek jera terhadap pelaku tindak pidana korupsi.
