SIM merupakan salah satu legitimasi dan kelengkapan wajib pengendara kendaraan bermotor yang diatur dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (LLAJ), termasuk Pasal 77 ayat (1), Pasal 106 ayat (5), dan Pasal 288 ayat (2).
Proses dan mekanisme penerbitannya diatur lebih lanjut dalam Peraturan Kepala Kepolisian Negara Republik Indonesia (Perkapolri) Nomor 9 Tahun 2012.

Masa Berlaku SIM: Dianggap Tidak Logis dan Tidak Adil
Ketua Presidium Corong Jabar, Yusuf Sumpena, S.H., S.P.M., yang akrab disapa Kang Iyus, menyoroti ketentuan dalam Perkapolri Nomor 9 Tahun 2012 Pasal 28 ayat (2) dan (3). Aturan tersebut menyebutkan bahwa jika SIM telah melewati batas waktu berlaku, walaupun hanya sehari (kecuali hari raya), pemilik SIM harus mengajukan pembuatan SIM baru dan tidak bisa diperpanjang, layaknya pemohon pemula.
“Ini sudah tidak logis, tidak bijak, dan tidak adil,” tegas Kang Iyus. “Masyarakat yang memiliki SIM telah melalui seluruh proses administrasi, uji teknik kemampuan, dan legalitas formal serta data forensik. Tidak ada bedanya dengan ijazah atau sertifikasi yang merupakan bukti legalitas formal atas kemampuan yang dimiliki seseorang.”
Kang Iyus menyatakan setuju dengan ketertiban dan kepatuhan terhadap aturan, namun ia berpandangan bahwa SIM seharusnya memiliki masa berlaku seumur hidup. Jika harus ada masa berlaku kadaluarsa, idealnya diperpanjang hingga 10 tahun.
“Jika pun ada masa kadaluarsa, hendaknya diberikan tenggang waktu beberapa minggu setelah tanggal kadaluarsa, karena orang bisa saja lupa atau tidak sempat mengurus perpanjangan,” tambahnya.
Syarat Kepemilikan BPJS Kesehatan yang Membebani
Selain masalah masa berlaku, Kang Iyus juga menyoroti aturan baru yang mulai berlaku sejak 1 November 2024, sesuai dengan Peraturan Kepolisian Nomor 2 Tahun 2023, yang mengharuskan pemohon SIM memiliki BPJS Kesehatan aktif.
“Aturan sekarang yang mensyaratkan SIM harus memiliki BPJS Kesehatan aktif sangat membebani masyarakat karena tidak semua masyarakat memiliki BPJS aktif,” tutur Kang Iyus.
Desakan Kepada DPR RI dan Kapolri
Corong Jabar mendesak DPR RI, khususnya Komisi III, sebagai wakil rakyat, untuk peka terhadap aturan hukum yang tidak memenuhi unsur keadilan di masyarakat.
“Perkapolri Nomor 9 Tahun 2012 dan aturan yuridis formal serta materil yang membebani dan menyulitkan masyarakat dalam aturan pembuatan SIM harus segera dievaluasi dan direvisi,” tutup Kang Iyus.
