JAKARTA, JURNAL TIPIKOR – Kejaksaan Agung (Kejagung) hari ini mengumumkan penyitaan dana senilai Rp1,3 triliun dari enam terdakwa korporasi yang terlibat dalam kasus dugaan korupsi pemberian fasilitas ekspor minyak sawit mentah (CPO) dan produk turunannya tahun 2022.
Penyitaan ini merupakan bagian dari upaya Kejagung untuk memulihkan kerugian negara akibat tindak pidana korupsi.
Direktur Penuntutan (Dirtut) pada Jaksa Agung Muda Bidang Tindak Pidana Khusus (Jampidsus) Kejagung, Sutikno, dalam konferensi pers di Gedung Kejaksaan Agung, Jakarta, Rabu (2/7/2025), menjelaskan bahwa enam terdakwa korporasi tersebut berasal dari dua grup perusahaan besar: Musim Mas Group dan Permata Hijau Group.
Rincian Penyitaan Dana:
- Musim Mas Group: Tujuh perusahaan dari grup ini, yaitu PT Musim Mas, PT Intibenua Perkasatama, PT Mikie Oleo Nabati Industri, PT Agro Makmur Raya, PT Musim Mas Fuji, PT Megasurya Mas, dan PT Wira Inno Mas, diwajibkan membayar uang pengganti atas kerugian perekonomian negara dengan total Rp4.890.938.943.794,01. Dari jumlah tersebut, PT Musim Mas telah menitipkan uang pengganti sebesar Rp1.188.461.774.666,00 kepada penyidik Jampidsus.
- Permata Hijau Group: Lima perusahaan dalam grup ini, yakni PT Nagamas Palmoil Lestari, PT Pelita Agung Agrindustri, PT Nubika Jaya, PT Permata Hijau Palm Oleo, dan PT Permata Hijau Sawit, dijatuhi pidana tambahan membayar uang pengganti sebesar total Rp937.558.181.691,26.
Kelima perusahaan ini telah menitipkan uang pengganti kepada penyidik sebesar Rp186.430.960.865,26.
Dengan demikian, total uang yang telah dititipkan dari enam terdakwa korporasi tersebut mencapai Rp1.374.892.735.527,05. Seluruh dana ini disimpan dalam Rekening Penampungan Lainnya (RPL) Jaksa Agung Muda Tindak Pidana Khusus pada Bank BRI.
Sutikno menambahkan bahwa setelah mendapatkan penetapan izin penyitaan dari Pengadilan Negeri Jakarta Pusat, jaksa penuntut umum (JPU) akan menyita seluruh uang yang dititipkan tersebut untuk kepentingan pemeriksaan pada tingkat kasasi.
Lanjutan Upaya Hukum Kasasi:
Keenam terdakwa korporasi tersebut sebelumnya telah diputus lepas dari segala tuntutan hukum oleh hakim di Pengadilan Tindak Pidana Korupsi (Tipikor) pada Pengadilan Negeri Jakarta Pusat. Menanggapi putusan tersebut, penuntut umum telah mengajukan upaya hukum kasasi, dan perkara ini masih dalam tahap pemeriksaan kasasi di Mahkamah Agung.
Frasa ‘menitipkan uang’ merujuk pada inisiatif para terdakwa untuk mengirimkan dana ke RPL Kejaksaan. Sutikno menjelaskan bahwa dalam surat mereka, dana tersebut dinyatakan sebagai “uang titipan untuk membayar ganti rugi terhadap kerugian negara yang ditimbulkan.”
Sebagai informasi, dalam laman resmi Direktori Putusan Mahkamah Agung (MA), Majelis Hakim menyatakan bahwa PT Wilmar Group, PT Permata Hijau Group, dan PT Musim Mas Group terbukti melakukan perbuatan sesuai dakwaan primer maupun subsider JPU.

Namun, Majelis Hakim menyatakan bahwa perbuatan tersebut bukan merupakan suatu tindak pidana (ontslag van alle recht vervolging), sehingga para terdakwa dilepaskan dari tuntutan JPU.
Para tersangka korporasi didakwa melanggar Pasal 2 ayat (1) dan Pasal 3 juncto Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2021 tentang Perubahan atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 ayat (1) ke-1 KUHP.
