Bandung, JURNAL TIPIKOR — Praktik jual beli jabatan yang melibatkan Kepala Daerah dan Aparatur Sipil Negara (ASN) di lingkup pemerintahan lokal menjadi sorotan tajam Badan Pemantau Kebijakan Publik (BPKP).
Lembaga ini menilai bahwa transaksi ilegal tersebut bukan sekadar pelanggaran etik, melainkan Tindak Pidana Korupsi (Tipikor) murni yang merusak pondasi tata kelola pemerintahan.
Ketua Umum BPKP, A. Tarmizi, pada Sabtu (13/12), menegaskan bahwa penempatan pejabat yang tidak didasarkan pada kredibilitas dan akuntabilitas adalah dampak langsung dari praktik suap ini, yang pada akhirnya melumpuhkan roda pemerintahan.
“Jual beli jabatan adalah salah satu bentuk suap-menyuap paling merusak. Dampaknya sistemik, karena posisi strategis diisi oleh orang yang membayar, bukan yang kompeten. Ini adalah kejahatan terhadap rakyat dan pemerintahan yang bersih,” ujar A. Tarmizi.

Jual Beli Jabatan = Suap-Menyuap: Jerat Pidana bagi Kedua Pihak
Berdasarkan analisis dan kajian hukum BP-KP, praktik jual beli jabatan secara tegas dikualifikasikan sebagai tindak pidana suap-menyuap yang diatur dalam Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, yang telah diubah dengan UU Nomor 20 Tahun 2001 (UU Tipikor).
BPKP menekankan bahwa dalam kasus ini, hukum pidana korupsi menjerat kedua belah pihak yang terlibat:
1. Jerat Pidana Bagi Penerima Suap (Kepala Daerah/Pejabat)
Pejabat atau Penyelenggara Negara yang menerima uang untuk menempatkan seseorang dijerat sebagai Suap Pasif.
- Pasal Relevan: Pasal 12 huruf a atau b, serta Pasal 11 UU Tipikor. Dalam kasus tertentu, bisa dikualifikasikan sebagai Pemerasan (Pasal 12 huruf e) atau Gratifikasi yang dianggap suap (Pasal 12B).
- Ancaman Pidana: Jauh lebih berat, yaitu penjara seumur hidup atau penjara minimal 4 tahun dan maksimal 20 tahun, serta denda hingga Rp1.000.000.000,00.

2. Jerat Pidana Bagi Pemberi Suap (ASN/Calon Pejabat)
Pihak yang memberi uang atau janji untuk mendapatkan posisi, yang kerap kali merupakan ASN atau calon ASN, dijerat sebagai Suap Aktif.
- Pasal Relevan: Pasal 5 ayat (1) huruf a atau b UU Tipikor. Pasal ini secara eksplisit mengatur pertanggungjawaban bagi setiap orang yang menjanjikan sesuatu kepada Penyelenggara Negara dengan maksud agar pejabat tersebut melakukan sesuatu yang bertentangan dengan kewajibannya.
- Ancaman Pidana: Penjara minimal 1 tahun dan maksimal 5 tahun, dan/atau denda minimal Rp50.000.000,00 dan maksimal Rp250.000.000,00.
Kesimpulan BPKP: Tak Ada Ampun, Keduanya Harus Dipidana
A. Tarmizi menyimpulkan bahwa sesuai dengan prinsip Tipikor sebagai bi-lateral crime (kejahatan dua pihak), baik yang disuap (penerima, dalam hal ini Kepala Daerah) maupun si penyuap (pemberi, dalam hal ini ASN) secara hukum harus dipertanggungjawabkan.
“Praktik penegakan hukum oleh KPK telah membuktikan konsistensi dalam menjerat kedua pihak. Jual beli jabatan adalah transaksi koruptif yang mensyaratkan perbuatan aktif dari dua sisi yang sama-sama melanggar hukum. BPKP mendesak agar penegak hukum tidak pandang bulu dan terus memberantas kejahatan ini hingga ke akar-akarnya,” tutup A. Tarmizi.
