Kab. Bandung, JURNAL TOPIKOR—Bupati Bandung Dr. HM. Dadang Supriatna mengadakan pertemuan dengan sejumlah perwakilan pedagang Pasar Banjaran yang belum sepakat atas pelaksanaan revitalisasi pembangunan Pasar Sehat Banjaran di ruang kerjanya di Soreang, Kamis (15/6/23).
Setelah pertemuan tersebut, Bupati Bandung menjelaskan bahwa jumlah pedagang Pasar Banjaran, eksisting itu ada 1.065 pedagang. Digabungkan dengan PKL , totalnya semua ada 1.690 pedagang.
“Saat ini yang sudah mengambil kunci dan setuju untuk pindah ke pasar sementara sudah 1.440 pedagang. Artinya sudah 85 persen, pedagang Pasar Banjaran ini sudah menyepakati revitalisasi Pasar Banjaran,” kata Dadang.
Sedikitnya 20 pedagang Pasar Banjaran memenuhi undangan Bupati Bandung Dadang Supriatna untuk bermusyawarah mencari solusi terkait persoalan revitalisasi Pasar Banjaran.
Pada pertemuan itu, Bupati Dadang Supriatna didampingi Kepala Disperdagin Dicky Anugrah dan Kepala Satpol PP Kabupaten Bandung, Ajat Sudrajat menampung beberapa aspirasi pedagang.
Bupati mengatakan ada tujuh poin/aspirasi yang disampaikan para pedagang dalam pertemuan yang berlangsung pada Kamis (15/06) di ruang kerjanya itu.

Pertama, para pedagang ini menyatakan akan mendukung revitalisasi jika dilakukan dengan cara menggunakan dana Anggaran Pendapatan Belanja Negara (APBN) atau Anggaran Pendapatan Belanja Daerah (APBD) Kabupaten Bandung, yang tidak membebankan pedagang. Aspirasi kedua, lanjut bupati, mereka menginginkan pengelolaan pasar dikembalikan lagi pada pemerintah
Hal yang ketiga, mereka melaporkan pasca kebakaran yang pernah menimpa pasar banjaran, para pedagang secara swadaya membangun kembali kios atas ijin dan petunjuk pemerintah daerah.
Aspirasi ke empat, mereka berharap pembayaran kios dilakukan setelah pembangunan selesai. Kelima, mereka meminta Pemerintah Kabupaten Bandung mengakui keberadaan para pedagang yang tergabung dalam Kelompok Warga Pedagang Pasar (Kerwappa) dan dilibatkan dalam kegiatan revitalisasi.

Sementara harapan yang ke enam, adalah adanya kebijakan khusus dalam penerapan harga pada para pedagang atas usulan Kerwappa.
“Sedangkan aspirasi mereka yang terakhir adalah konpensasi kios-kios yang telah dibangun oleh dana swadaya pedagang diminta pembayarannya sebelum dilakukan pembangunan,” beber bupati.
Menyikapi asprasi-aspirasi itu, bupati yang akrab disapa Kang DS ini mengungkapkan pihaknya tentu akan memberikan atensi penuh.
Namun, ia pun meminta para pedagang bisa memahami mekanisme dan aturan-aturan yang ada dalam proses pemerintahan.
“Dengan keterbatasan APBD, tentunya apa yang menjadi harapan mereka agar dana revitalisasi menggunakan APBD, untuk saat ini tidak dapat kita penuhi. Mengingat APBD tidak hanya terfokus pada satu kegiatan saja, namun terbagi-bagi pada program-program pembangunan lainnya,” ucap Kang DS.
Lebih jauh Kang DS menjelaskan dalam setiap proses pemerintahan ada aturan-aturan yang sudah disepakati oleh Pemkab Bandung selaku eksekutif dan pihak legislatif. “Program-program yang sudah kita rencanakan tertuang dalam RPJMD yang tentunya sudah disepakati oleh dewan sebagai fungsi legislasi”ujarnya.
Kang DS mengakui, dalam merevitalisasi Pasar Banjaran masih ada pedagang yang tidak sefaham dengan pihakmya.
“Jika masih ada yang belum sepakat, saya membuka ruang komunikasi untuk kita diskusikan. Nantinya pasti akan ada titik temu dan menghasilkan solusi terbaik bagi semuanya,” ungkapnya.
Ia menjelaskan saat ini Pemkab Bandung tengah menghadapi proses hukum di PTUN terkait permasalahan revitalisasi Pasar Banjaran.
“Proses hukum, silahkan terus berlanjut. Kami sangat menghargai. Saat ini memang belum ada kesepahaman antara kita. Selama proses hukum berjalan, Saya minta Kepala Diperdagin dan Kasatpol PP membuka pola komunikasi yang lebih humanis dengan para pedagang ini,agar tidak ada kesan mengintimidasi” tegasnya pula.

Sementara itu, Advokat dari Tim Kuasa Hukum Jaringan Advokasi Rakyat Miskin Indonesia yang juga Kuasa Hukum Para Pedagang Pasar Banjaran Harry Haswidy, S.H., mengatakan, bahwa pertemuan dengan Bupati Bandung belum bisa disepakati apa-apa. “Ini adalah pertemuan pertama antara pedagang dengan Bupati langsung, untuk membahas berkaitan dengan permasalahan revitalisasi Pasar Banjaran. Jadi nanti akan ada pertemuan- pertemuan berikutnya untuk membahas secara detail, apa yang menjadi tuntutan para pedagang dan apa yang menjadi ketetapan dari Bupati Bandung dalam hal ini Pemerintah Kabupaten Bandung berkaitan dengan Pasar Banjaran,” tutur Harry.
Harry mengungkapkan dari poin-poin yang disampaikan kepada Bupati Bandung, para pedagang pada intinya mendukung revitalisasi Pasar Banjaran.
“Akan tetapi menginginkan menggunakan dana APBD dan APBN. Yang kedua adalah para pedagang ingin ada harga kios yang sesuai dengan kemampuan para pedagang,” ujar Harry.
Kemudian yang ketiga, kata Harry, ada kebijakan khusus melibatkan kelompok warga pedagang (kewarpa), dalam hal ini sebagai organisasi pedagang Pasar Banjaran. “Untuk dilibatkan dalam revitalisasi Pasar Banjaran. Kemudian yang keempat, adanya konpensasi kios karena kios ini dibangun secara swadaya oleh para pedagang,” katanya.
Harry mengatakan pada intinya pedagang itu, jangan sampai revitalisasi Pasar Banjaran memberatkan para pedagang.
“Pak Bupati tadi sudah mengetahui langsung fakta-fakta di lapangan selama ini terjadi, mengenai intimidasi terhadap pedagang sudah disampaikan. Dan kami apresiasi, Bupati sudah memerintahkan Kasatpol PP dan Kepala Dinas Perdagangan dan Perindustrian untuk menghindari tindakan-tindakan mengarah ke intimidasi,” katanya.

Harry mengatakan, terkait dengan konpensasi kios, pihaknya akan membicarakannya dengan pihak pengembang. Karena tadi dalam pertemuan dengan Bupati itu, katanya, masih dalam ranah menyampaikan informasi dari para pedagang. “Yang tidak mungkin bisa disepakati dalam satu hari ini karena poin-poinnya banyak. Nanti akan ada pertemuan-pertemuan lanjutan,” ujarnya.
Dikatakannya, sebagai kuasa hukum dari para pedagang tersebut, juga diarahkan bertemu langsung dengan Bupati Bandung. “Jadi tidak dengan Kepala Dinas ataupun Satuan Kerja Pemerintah Daerah. Bupati langsung yang akan bertemu dengan kita, para pedagang yang juga diwakili kuasa hukum,” katanya.
Harry mengatakan harga kios itu variatif dan tidak sama. Untuk pedagang lama itu lebih murah, dibandingkan dengan pedagang baru. Harga kios per meter paling rendah Rp 16 juta sampai Rp 20 juta.
“Kita minta ada kebijakan khusus mengenai harga kios. Terutama ini nanti akan disampaikan melalui kewarpa sebagai organisasi pedagang di Pasar Banjaran. “Nanti para pedagang itu menyampaikan apa yang diinginkan, berapa harganya, kita sampaikan nanti ke kewarpa. Kewarpa nanti ketemu dengan pihak pengembang,” katanya.
Kondisi di lapangan, kata dia, masih ada kegiatan-kegiatan pembongkaran kios. “Dan itu perlu diketahui, pembongkaran kios itu hanya bagi kios-kios yang pedagangnya sudah mendaftarkan atau ikut membeli kios. Jadi untuk yang belum daftar membeli kios, belum dibongkar,” katanya.
Ia mengatakan para pedagang yang masih bertahan itu, dalam artian belum mendaftar membeli kios. “Jadi nanti kalau ada kesepakatan, ya jelas semua pasti akan dibongkar,” katanya.
Menurutnya, pemagaran seng, juga sudah disampaikan dan dihimbau untuk dibuka karena menghalangi pedagang yang sedang berjualan saat ini.
