Jakarta, JURNAL TIPIKOR – Transparency International Indonesia (TII) menyatakan sudah saatnya Pasal 2 atau Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi (UU Tipikor) yang mengatur perihal kerugian negara segera direvisi. TII menilai pasal tersebut bersifat “sapu jagat” dan rentan disalahgunakan untuk menjerat siapa saja, termasuk membungkam suara-suara kritis.
Sekretaris Jenderal TII, Danang Widoyoko, menyampaikan kekhawatiran ini dalam sebuah diskusi bertema ‘Keputusan Korporasi Berujung Vonis Bui’ pada Senin (24/11).
“Mengapa perlu direvisi? Karena politik-hukumnya sudah berbeda… Saya malah khawatir mengarah pada otoritarianisme, dan di dalam negara-negara otoriter, Pasal antikorupsi sangat efektif untuk membungkam mereka yang kritis,” ujar Danang.
Menurut Danang, penindakan kasus dugaan korupsi kian mengarah pada praktik pembungkaman, mencontohkan kasus yang pernah menjerat mantan Menteri Perdagangan, Tom Lembong.

Ia menegaskan bahwa di bawah kekuasaan politik-hukum saat ini, pasal-pasal tersebut akan makin banyak digunakan.
Kekhawatiran yang sama juga diungkapkan oleh Aristo Pangaribuan, Pakar Hukum Pidana Universitas Indonesia (UI). Ia menyoroti tipisnya batas antara prinsip Business Judgement Rule (BJR) dan tindak pidana korupsi.
“Memang tidak disyaratkan kalau dia tidak menerima kickback (suap) itu bukan tindak pidana korupsi. Artinya, seperti saya katakan, Pasal ini berfungsi seperti pukat harimau,” jelas Aristo.
Ia menambahkan bahwa pasal kerugian negara memiliki cakupan yang terlalu luas, tidak hanya menangkap ‘ikan’ koruptor, tetapi juga ‘biota-biota laut’ lain yang sebenarnya berguna bagi ekosistem bisnis.
Persoalan BJR dan Kasus Eks Dirut ASDP
Tuntutan revisi ini kembali mencuat setelah vonis terhadap mantan Direktur Utama PT ASDP, Ira Puspadewi, dan dua direktur lainnya, Muhammad Yusuf Hadi dan Harry Muhammad Adhi Caksono, pada Kamis (20/11) lalu.
Majelis hakim Pengadilan Tipikor Jakarta menghukum Ira Puspadewi 4 tahun 6 bulan penjara karena terbukti merugikan negara hingga Rp1,25 triliun dalam kasus Kerja Sama Usaha (KSU) dan akuisisi PT Jembatan Nusantara (JN) oleh PT ASDP tahun 2019-2022.
Meski demikian, putusan tersebut diwarnai perbedaan pendapat (dissenting opinion) dari Ketua Majelis Hakim, Sunoto, yang menilai Ira dkk seharusnya divonis bebas (ontslag van alle recht vervolging) karena tindakan akuisisi dilindungi oleh prinsip BJR dan lebih tepat diselesaikan secara perdata.
Secara mengejutkan, Presiden RI Prabowo Subianto pada Selasa (25/11) memberikan rehabilitasi terhadap Ira, Yusuf, dan Harry, serta meminta Komisi Hukum DPR untuk mengkaji penyelidikan yang telah berjalan sejak Juli 2024.
Wakil Ketua DPR, Sufmi Dasco Ahmad, mengonfirmasi keputusan rehabilitasi tersebut setelah menerima aspirasi dari masyarakat dan melakukan kajian di Komisi III DPR.
KUHP Baru sebagai Solusi Jangka Panjang
Aristo Pangaribuan menyebut bahwa persoalan ini merupakan pekerjaan rumah besar penegakan hukum di Indonesia. Ia optimistis bahwa Kitab Undang-Undang Hukum Pidana (KUHP) baru, yang akan berlaku dua bulan lagi, dapat menjadi solusi.
“Makanya di KUHP baru kita… Pasal itu dipersempit. Kemudian di Pasal prinsip pemidanaan itu ditekankan bahwa dalam memidanakan orang harus dieksaminasi dulu mens rea-nya atau sikap batiniah dan tujuannya,” tutup Aristo.
TII berharap DPR dan Pemerintah segera merespons desakan revisi ini untuk menciptakan kepastian hukum dan mencegah penyalahgunaan pasal-pasal antikorupsi. (CNN)
