BPJS Masuk dalam Struktur Kemenkes RI, Inilah yang Dikhawatirkan
Jakarta, JURNAL TIPIKOR-Soal BPJS Kesehatan berada di dalam struktur Kementerian Kesehatan RI sesuai dengan isi RUU kesehatan malah menuai Pro kontra.
Contoh saja, yang disuarakan Ketua Yayasan Lembaga Konsumen Indonesia (YLKI), Tulus Abadi.
Menurutnya, posisi BPJS Kesehatan di dalam struktur Kemenkes RI bakal merupakan konstruksi tidak benar.
“Kalau kemudian pasal 425 ayat 2, tentu RUU Kesehatan yang kita baca secara eksplisit mengubah status BPJS Kesehatan menjadi badan hukum yang bertanggung jawab tetap ke Presiden tetapi harus melalui Kemenkes dahulu,” ungkapnya dalam media briefing di Jakarta Selatan, Jumat (31/3/2023).

“Ini pada akhirnya menjadikan secara kelembagaan BPJS Kesehatan menjadi subordinat Kemenkes. Saya kira satu konstruksi yang tidak betul,” sambung Tulus.
Menurutnya, jika tujuannya adalah mempermudah koordinasi antara BPJS Kesehatan dengan Kementerian Kesehatan RI, tak harus dimuat dalam RUU Kesehatan. Walhasil, tidak tepat jika keperluan koordinasi menjadi alasan penempatan BPJS Kesehatan menjadi di dalam struktur Kemenkes sebagaimana dimuat RUU Kesehatan.
“Apakah selama ini tanpa adanya RUU Kesehatan tidak bisa berkoordinasi antara BPJS Kesehatan dengan Kemenkes RI jadi terminologi ‘koordinasi’ dalam RUU Kesehatan Omnibus Law memang secara konkret ingin menjadikan subordinat menjadi sangat tidak tepat,” bebernya.

“Kalau koordinasi ya yal yang biasa dilakukan untuk kementerian dan lembaga saling berkoordinasi. Jadi tidak masuk akal,” pungkas Tulus.
Senada, koordinator BPJS Watch, Timboel Siregar, menegaskan sebenarnya koordinasi antara BPJS Kesehatan dengan Kemenkes RI sebenarnya selama ini sudah ada. Misalnya terkait keterbukaan data dari pihak BPJS, yang kemudian bisa digunakan oleh pihak lain, termasuk Kemenkes untuk membuat regulasi dan kebijakan.
“Waktu itu yang diambil contoh adalah tentang gagal ginjal akut. Bagaimana mereka meminta BPOM menyerahkan datanya. Kalau untuk BPJS Kesehatan, sebenarnya terkait data sebenarnya di Perpres 82 sudah diatur juga. Kan bisa diakses Kemenkes dan sebagainya. Artinya, koordinasi sudah diatur sedemikian rupa dalam regulasi. Saya juga nggak membayangkan BPJS Kesehatan ngumpetin data, kan nggak,” ungkap Timboel.
“Data-data yang ada di BPJS Kesehatan menjadi sumber bagaimana pemerintah membuat kebijakan regulasi. Kalau sekarang penyakit katastropik paling tinggi adalah jantung, biaya paling tinggi adalah jantung. Sehingga bagaimana mengatasi persoalan jantung, ini kan gaya hidup. Makanya 14 jenis skrining salah satunya jantung yang dilegitimasi dalam Permenkes,” pungkasnya.

Dalam kesempatan sebelumnya, juru bicara Kemenkes RI Mohammad Syahril membantah kabar RUU Kesehatan Omnibus Law bakal ikut mengatur perubahan BPJS Kesehatan menjadi berada di bawah wewenang Menteri Kesehatan RI. Menurutnya, dalam draft resmi RUU Kesehatan tercantum jelas soal posisi badan hukum BPJS Kesehatan.
“Dalam BAB XII RUU Kesehatan Pasal 425 dijelaskan bahwa BPJS tetap merupakan badan hukum publik dan bertanggung jawab kepada Presiden melalui Menteri Kesehatan,” tutur dia dalam keterangan tertulis yang diterima detikcom Selasa (14/3).
“Jadi tetap berada di bawah Presiden namun berkoordinasi dengan Menteri Kesehatan. Jadi BPJS tidak berada di dalam struktur Kemenkes RI,” sambung Syahril.
