Jakarta, JURNAL TIPIKOR – Komisi Pemberantasan Korupsi (KPK) akhirnya menetapkan Mantan pejabat Direktorat Jenderal (Ditjen) Pajak Rafael Alun Trisambodo jadi tersangka soal kasus dugaan korupsi yang melibatkannya.

Rafael Alun Tersangka KPK Kasus Gratifikasi 12 Tahun
KPK menetapkan Rafael Alun Trisambodo sebagai tersangka atas kasus gratifikasi. Rafael diduga menerima gratifikasi dalam bentuk uang selama 12 tahun terakhir.
“Jadi ada peristiwa pidana korupsinya telah kami temukan terkait dengan dugaan korupsi penerimaan sesuatu oleh pemeriksa pajak pada DJP Kemenkeu tahun 2011 sampai 2023,” kata Kabag Pemberitaan KPK Ali Fikri di gedung KPK, Jalan Kuningan Persada, Jakarta Selatan, Kamis (30/3).
Ali mengatakan KPK telah menemukan peristiwa pidana dan dua alat bukti dalam kasus gratifikasi yang melibatkan Rafael Alun.

Kabag Pemberitaan KPK Ali Fikri mengatakan pemeriksaan para saksi setelah Rafael Alun ditetapkan sebagai tersangka masih akan terus dilakukan.
“Ya kebutuhan siapa yang perlu dipanggil sebagai saksi pasti kan nanti kami lakukan. Cuma kan semuanya butuh waktu untuk dilakukan analisis dulu, fakta-fakta mana yang dibutuhkan, keterangan misalnya,” kata Ali di gedung KPK, Jalan Kuningan Persada, Jakarta Selatan, Kamis (30/3).
Ali mengatakan pihaknya juga membuka peluang untuk kembali memeriksa keluarga Rafael, termasuk istri dan anaknya. Istri Rafael telah diperiksa saat kasus korupsi Rafael masih dalam tahap penyelidikan.

Rafael Alun Terancam Hukuman 20 Tahun Penjara
Rafael Alun tersangka KPK kasus gratifikasi terancam hukuman maksimal 20 tahun penjara. Gratifikasi sendiri diatur dalam Pasal 12B UU No. 20 tahun 2001 tentang Pemberantasan Korupsi. Berikut bunyinya:
(2) Pidana bagi pegawai negeri atau penyelenggara negara sebagaimana dimaksud dalam ayat (1) adalah pidana penjara seumur hidup atau pidana penjara paling singkat 4 (empat) tahun dan paling lama 20 (dua puluh) tahun, dan pidana denda paling sedikit Rp 200.000.000,00 (dua ratus juta rupiah) dan paling banyak Rp 1.000.000.000,00 (satu miliar rupiah).
Rafael Alun Diduga Terima Gratifikasi Hingga Rp 40 M
Uang gratifikasi yang diterima Rafael diduga capai puluhan miliar. Direktur Penyidikan KPK Asep Guntur mengatakan temuan safe deposit box (SDB) Rafael berisi uang puluhan miliar jadi pintu masuk KPK usut dugaan gratifikasi.
“Beberapa perkara itu menjadi pintu masuk perkara utamanya. Karena waktu itu PPATK mengecek SDB ditemukan Rp 36-40 miliar. Tapi tentunya uang tersebut harus kita telusuri dari mana,” kata Asep di gedung KPK, Jalan Kuningan Persada, Jakarta Selatan, Kamis (30/3).

Dia menjamin penyidik sudah mengantongi cukup bukti dalam penyidikan terhadap Rafael Alun. Asep mengatakan konstruksi perkara akan dijelaskan secara lengkap dalam konferensi pers.
KPK Sita Barang Mewah-Uang Usai Geledah Rumah Rafael
Sejumlah barang mewah ditemukan KPK usai lakukan penggeledahan terhadap rumah Rafael Alun tersangka KPK. Penggeledahan itu dilakukan pada Senin (27/3) di kawasan Jakarta Selatan.
“Dalam penggeledahan juga ditemukan beberapa barang mewah,” kata Direktur Penyidikan KPK Asep Guntur di gedung KPK, Jalan Kuningan Persada, Jakarta Selatan, Kamis (30/3/2023).
Sumber detikcom mengatakan barang mewah itu adalah tas milik istri Rafael. Di antaranya yang disita adalah tas merek Louis Vuitton (LV) dan Chanel. Selain itu, penyidik juga menyita sejumlah uang tunai.
“Jumlah tas-nya puluhan, diduga koleksi istri RAT,” ujar sumber detikcom, Jumat (31/3).

Respon Rafael: Menerima Penetapannya Jadi Tersangka
Rafael Alun menghormati penetapan dirinya sebagai tersangka KPK itu. “Saya akan menerima karena ini konsekuensi saya,” kata Rafael di Jakarta, Kamis (30/3).
Rafael menyatakan siap menghadapi proses hukum dan akan menghadapi sesuai peraturan yang ada. “Saya nggak bisa apa-apa. Jadi saya menerima saja,” ucapnya.
Langkah hukum ke depan, Rafael akan menyerahkan ke tim hukumnya. “Saya hanya bisa berkonsultasi dengan tim pengacara saya,” ucapnya.

Rafael mengatakan uang yang berada di SDB miliknya itu diperoleh dari hasil penjualan tanah di tahun 2010. Ada empat tanah yang dijualnya.
