Istana Negara, Jakarta Presiden Prabowo Subianto Berikan Rehabilitasi kepada Eks Dirut ASDP Ira Puspadewi dan Dua Terdakwa Lain
Jakarta, JURNAL TIPIKOR – Presiden Republik Indonesia, Prabowo Subianto, secara resmi telah memberikan rehabilitasi kepada tiga terdakwa dalam kasus dugaan korupsi Kerja Sama Usaha (KSU) dan akuisisi PT Jembatan Nusantara (JN) oleh PT ASDP periode 2019-2022.
Ketiga nama yang direhabilitasi adalah:
- Ira Puspadewi, mantan Direktur Utama PT ASDP.
- Muhammad Yusuf Hadi, Direktur Komersial dan Pelayanan PT ASDP.
- Harry Muhammad Adhi Caksono, Direktur Perencanaan dan Pengembangan PT ASDP.
Wakil Ketua DPR RI, Sufmi Dasco Ahmad, mengumumkan keputusan ini dalam konferensi pers di Istana Kepresidenan Jakarta pada Selasa (25/11). “Dari hasil komunikasi dengan pihak pemerintah, Alhamdulillah pada hari ini Presiden RI Prabowo Subianto telah menandatangani surat rehabilitasi terhadap tiga nama tersebut,” ujar Dasco.
Dasco menjelaskan bahwa DPR RI menerima berbagai aspirasi dan pengaduan masyarakat terkait permasalahan ASDP sejak periode Juli 2024. Pihaknya kemudian meminta Komisi III DPR RI untuk melakukan kajian terhadap penyelidikan kasus tersebut.
Latar Belakang Kasus dan Putusan Pengadilan.
Sebelumnya, Majelis Hakim Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta telah menjatuhkan vonis penjara kepada ketiga terdakwa:
- Ira Puspadewi: Hukuman 4 tahun 6 bulan penjara dan denda Rp500 juta subsider 3 bulan kurungan.
- Muhammad Yusuf Hadi dan Harry Muhammad Adhi Caksono: Masing-masing divonis 4 tahun penjara dan denda Rp250 juta subsider 3 bulan kurungan.
Hakim menyatakan para terdakwa terbukti merugikan keuangan negara hingga Rp1,25 triliun. Namun, putusan tersebut tidak diambil secara bulat dan diwarnai oleh dissenting opinion atau perbedaan pendapat dari Ketua Majelis Hakim, Sunoto.
Menurut Sunoto, Ira Puspadewi dkk. seharusnya divonis lepas (ontslag van alle recht vervolging) karena ia menilai tidak ada tindak pidana korupsi dalam kasus tersebut.
Sunoto berpendapat kasus ini lebih tepat diselesaikan secara perdata karena tindakan akuisisi PT JN dilindungi oleh prinsip Business Judgment Rule (BJR).
Arti Rehabilitasi
Rehabilitasi adalah hak seseorang untuk mendapat pemulihan dalam kemampuan, kedudukan, dan harkat serta martabatnya.
Hal ini diatur dalam Pasal 1 Angka 23 KUHAP dan diperkuat oleh Pasal 97 ayat (1) KUHAP lama yang menyebut bahwa seseorang berhak memperoleh rehabilitasi apabila oleh pengadilan diputus bebas atau diputus lepas dari segala tuntutan hukum yang putusannya telah mempunyai kekuatan hukum tetap.
Keputusan rehabilitasi oleh Presiden Prabowo Subianto ini secara langsung memulihkan kembali harkat, martabat, dan kedudukan ketiga mantan pejabat PT ASDP tersebut.
