Bekasi, JURNAL TIPIKOR–Kasus perkara pelecehan seksual terhadap seorang Anak perempuan yang masih dibawah umur berinisial N-A-T (15) tahun, telah di putuskan oleh Pengadilan Negeri Kota Bekasi, pada Rabu 5 Juli 2023, lalu.
Dalam persidangan Majelis Hakim tunggal yang dipimpin Hosiana Mariani SIDABALOK memutus perkara ini dengan menjatuhkan hukuman pada terdakwa Rangga Aditya 2 tahun 6 bulan kurungan penjara.
Putusan Majelis Hakim ini turun drastis dari tuntutan Jaksa Penuntut yaitu 7 tahun hukuman penjara. Turun drastisnya putusan hukuman ini, dinilai janggal oleh kuasa hukum korban.
“Hakim memutuskan lebih rendah dari tuntutan jaksa Penuntut umum. Diduga ada indikasi intimidasi terhadap keluarga korban dari awal sampai akhir persidangan bahwa Hakim tidak menunjukkan Profesionalisme nya dalam penanganan kasus anak,” ungkap Agustina Magdalena, kuasa hukum korban, saat memberikan keterangan pada awak media, Sabtu 8 Juli 2023.

Agustina menilai, selama proses persidangan, majelis hakim menunjukkan jalannya persidangan banyak terlihat tidak netral.
“Intonasi yang keras dalam memimpin persidangan, pertanyaan yang menyudutkan, tidak diberikannya keleluasaan korban dan keluarga korban dalam menjawab, itulah yang membuat keluarga merasa di Intimidasi sampai akhirnya putusan ini ketuk palu,” jelas Agustina Magdalena Nainggolan S.H.M.H ( LENA )
Lena panggilan akrabnya menyoroti proses persidangan di detik-detik akhir saat putusan.
Menurut Lena, Hakim Tunggal di Pengadilan Negeri Kota Bekasi dalam persidangan putusan, yang harusnya terbuka, malah tertutup dan tidak diperbolehkan beberapa pihak masuk ke dalam ruang persidangan. Bahkan penyidik menjaga pintu persidangan agar tak masuk.

“Keluarga korban selalu didesak perdamaian bahkan dipersidangan disodorkan Perjanjian kesepakatan yang terdiri dari beberapa poin,” imbuhnya.
Lena membeberkan, sejumlah poin yang memberatkan keluarga korban diantaranya, poin pertama penasehat hukum pelaku menyodorkan bahwa, para pihak bersepakat untuk damai padahal tidak ada niat sama sekali untuk berdamai hanya yang ditekankan bagaimana pertanggung jawaban pelaku terhadap anak yang terlahir ini. Tak hanya itu tambah Lena, keluarga korban merasa ada desakan dan paksaan dalam memberikan jawaban hingga sudah di buat kesepakatan.
Dalam persidangan sebelumnya dengan agenda acara tuntutan. Jaksa menuntut hukuman kurungan selama 7 tahun terhadap pelaku, namun vonis hukuman pada Rabu kemarin hanya 2,6 tahun
“Sangat jauh turunnya yaitu 2 tahun 6 bulan kurangi masa tahanan 1 bulan dan denda 10 juta di ganti hukuman 6 bulan apabila tidak sanggup membayar,” terang Lena.

Atas putusan tersebut yang dianggap sangat janggal dan turun drastis, pihak keluarga dan penasehat hukum sangat kecewa atas Hasil Vonis Hakim.
“Padahal Keluarga Korban sudah sangat memohon keadilan dan dapat ganti rugi dari hasil putusan ini, ternyata semua perjuangan tidak sesuai dengan hasil yang di tunjuk kan oleh Majelis Hakim PN Bekasi,” terang Lena lagi.
Terkait hasil putusan, kuasa hukum korban akan mengajukan banding dari hasil vonis Hakim terhadap pelaku kekerasan terhadap anak di bawah umur.
Pihak keluarga akan terus berjuang dengan berkoordinasi bersama Kejaksaan Agung dan Mahkamah Agung meminta Keadilan untuk keluarga Korban Kekerasan Terhadap Anak di bawah umur.
“Kiranya Jeritan orang tua korban dapat di dengarkan dan mendapatkan hasil sesuai dengan keinginan nya, yaitu pelaku di hukum maksimal dan Korban mendapatkan Ganti Rugi (Restitusi),” tegas Lena.
