Purwokerto, JURNAL TIPIKOR – Pakar hukum Universitas Jenderal Soedirman Purwokerto Prof Hibnu Nugroho menilai pemberlakuan surat keterangan catatan kepolisian (SKCK) layak dihapus karena tidak selaras dengan hak asasi manusia (HAM) dan berpotensi menghalangi hak warga negara untuk memperoleh pekerjaan.
“Dalam hal sisi hak asasi manusia, itu (SKCK) memang sangat merugikan,” katanya di Purwokerto, Kabupaten Banyumas, Jawa Tengah, Sabtu.
Oleh karena itu, dia mengaku sepakat dengan usulan penghapusan layanan penerbitan SKCK yang selama ini dilayani oleh Kepolisian Negara Republik Indonesia.
Dalam hal ini, SKCK merupakan catatan seseorang sebagai bukti bahwa yang bersangkutan berperilaku baik atau tidak pernah melakukan tindak kriminal atau kejahatan berdasarkan data kepolisian.

Menurut dia, pemberlakuan SKCK membatasi hak asasi manusia dan sangat merugikan terutama bagi mantan narapidana ketika hendak mencari pekerjaan yang layak.
Ia mengatakan perilaku pencari kerja sebenarnya dapat terlihat saat yang bersangkutan menjalani wawancara, apakah sesuai atau tidak sesuai dengan kehendak perusahaan selaku pengguna.
Bahkan, kata dia, SKCK dapat menjadikan stigma negatif bagi orang-orang yang mempunyai catatan-catatan negatif karena pernah melakukan tindak kriminal atau kejahatan.

Padahal, lanjut dia, belum tentu pekerjaan yang diinginkan orang itu selaras dengan apa yang dilakukan ataupun pekerjaan tersebut selaras dengan penggunanya.
“Jangan sampai orang mau berusaha, sudah mendapatkan stigma negatif dulu, itu yang tidak boleh. Padahal saat sekarang, mantan narapidana kasus korupsi boleh mencalonkan diri dalam pilkada, kenapa mantan narapidana lainnya harus terkendala dalam mencari pekerjaan karena adanya catatan negatif dari kepolisian,” kata Hibnu menegaskan.
Sebelumnya, Kementerian HAM berkirim surat kepada Kapolri Jenderal Pol Listyo Sigit Prabowo yang berisi usulan agar SKCK dihapus karena dinilai berpotensi menghalangi hak asasi warga negara.
Direktur Jenderal Instrumen dan Penguatan HAM Kementerian HAM Nicholay Aprilindo mengatakan surat tersebut ditandatangani oleh Menteri HAM Natalius Pigai dan telah dikirim ke Mabes Polri pada Jumat (21/3).
“Alhamdulillah tadi Pak Menteri sudah menandatangani surat usulan kepada Kapolri untuk melakukan pencabutan SKCK dengan kajian yang kami telah lakukan secara akademis maupun secara praktis,” kata Nicholay.
Dia menjelaskan usulan tersebut muncul setelah Kementerian HAM melakukan pengecekan ke berbagai lembaga pemasyarakatan (lapas) di sejumlah daerah. Dalam kunjungan tersebut, ditemukan narapidana residivis.
Mantan narapidana kembali dibui karena kesulitan mencari pekerjaan setelah keluar dari lapas sehingga terpaksa mengulangi perbuatan melanggar hukum. Mereka terbebani dengan adanya SKCK yang menjadi syarat pada lowongan kerja.
Menurut Nicholay, sekalipun mantan narapidana mendapatkan SKCK, terdapat keterangan yang menyatakan bahwa mereka pernah dipidana. Oleh sebab itu, sukar perusahaan atau tempat pekerjaan lain mau menerima mantan narapidana.
