Jakarta, JURNAL TIPIKOR – Jaksa penuntut umum (JPU) KPK mengatakan bahwa pihaknya sudah memberi kesempatan kepada Sekretaris Jenderal PDI Perjuangan Hasto Kristiyanto untuk mengajukan saksi meringankan (a de charge) saat penyidikan kasus dugaan perintangan penyidikan (obstruction of justice) Harun Masiku dan pemberian suap.
“Dalam berita acara pemeriksaan (BAP) tersangka Hasto Kristiyanto tertanggal 27 Februari 2025 nomor 72, penyidik telah memenuhi kewajibannya dengan menanyakan kepada tersangka apakah ada saksi yang meringankan atau a de charge,” kata jaksa di Pengadilan Tindak Pidana Korupsi Jakarta, Kamis (27/3/2025).
Menurut jaksa, penyidik telah menjalankan ketentuan Pasal 65 juncto Pasal 116 ayat (3) dan (4) Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Akan tetapi, pada pemeriksaan saat itu Hasto menjawab belum mengajukan saksi meringankan, sebagaimana BAP tanggal 27 Februari.
“Berdasarkan ketentuan pasal tersebut, penyidik telah melaksanakan kewajiban dan tidak pernah membatasi hak tersangka untuk mengusahakan dan mengajukan saksi dan/atau seseorang yang memiliki keahlian khusus pada tahap penyidikan,” kata jaksa menekankan.

Lebih lanjut penasihat hukum Hasto pada tanggal 4 Maret 2025 mengajukan surat terkait dengan permohonan pemeriksaan ahli meringankan. Permohonan itu diajukan setelah berkas perkara dinyatakan lengkap oleh penuntut umum.
“Apabila terdakwa, saat itu tersangka, atau penasihat hukumnya akan mengajukan saksi atau ahli yang meringankan terdakwa, dapat diajukan dalam tahap pemeriksaan persidangan,” ujar jaksa.
Berdasarkan uraian tersebut, jaksa penuntut umum komisi antirasuah menilai dalih Hasto dan penasihat hukumnya dalam nota keberatan atau eksepsi selayaknya ditolak.

Sebelumnya, Hasto saat membacakan nota keberatan atau eksepsi, Jumat (21/3), merasa haknya terabaikan setelah permohonan saksi meringankan tidak dihiraukan oleh KPK pada tahap penyidikan.
“Penasihat hukum saya telah mengajukan permohonan resmi untuk memeriksa saksi-saksi meringankan kepada pimpinan KPK pada tanggal 4 Maret 2024. Namun, permohonan tersebut diabaikan oleh KPK,” kata Hasto.
Menurut dia, KPK justru mengandalkan saksi-saksi internal yang cenderung memberatkan dirinya dengan total ada 13 penyelidik dan penyidik KPK yang menjadi saksi dalam kasusnya, termasuk Rossa Purbo Bekti.

Hasto menuturkan bahwa semua saksi tersebut memberatkan dirinya, sedangkan saksi-saksi meringankan yang pihaknya ajukan tidak diperiksa.
Maka dari itu, dia menilai KPK melanggar asas proporsionalitas dalam penyidikan kasus yang menjeratnya dengan memaksakan proses hukum yang tidak seimbang dan cenderung merugikan dirinya.(*)
