Jakarta, JURNAL TIPIKOR – Wakil Menteri Hukum (Wamenkum) Edward Hiariej mengatakan bahwa Kitab Undang-undang Hukum Pidana (KUHP) baru yang akan berlaku pada tanggal 2 Januari 2026 mengatur agar hakim sebisa mungkin tidak langsung menjatuhkan pidana penjara.
Pasalnya, kata dia, visi KUHP baru merupakan reintegrasi sosial untuk mencegah penjatuhan pidana penjara dalam waktu singkat.
“Supaya saudara-saudara yang lulusan Poltekip ini tidak banyak kerjaan di lembaga pemasyarakatan, tetapi pekerjaan Anda nanti paling banyak di luar lembaga pemasyarakatan,” ujar Eddy, sapaan karib Wamenkum, dalam acara Webinar Sosialisasi UU Nomor 1 Tahun 2023 tentang KUHP di Jakarta, Kamis (30/1/2025)

Dalam KUHP baru, kata dia, terdapat jenis pidana lain seperti pidana kerja sosial dan pidana pengawasan. Jenis pidana tersebut akan ditangani oleh Balai Pemasyarakatan (Bapas) sehingga bukan lagi merupakan tugas lembaga pemasyarakatan (lapas).
Dengan demikian, lanjut dia, Bapas akan memegang peranan penting setelah implementasi KUHP baru karena ada pengalihan jenis pidana dari pidana penjara menjadi pidana pengawasan dan pidana kerja sosial.
Kendati demikian, kata Eddy, penjara masih merupakan pidana pokok dalam KUHP baru, penjara merupakan pidana terberat kedua.
Dalam KUHP terbaru, dia mengungkapkan terdapat pasal yang menyatakan bahwa hakim wajib menerapkan sanksi pidana yang lebih ringan dalam menjatuhkan pidana.
Dalam beleid itu, terdapat beberapa pidana pokok yang bisa dijatuhkan kepada pelaku, yakni mulai dari yang paling ringan berupa pidana denda, pidana kerja sosial, pidana pengawasan, pidana penjara, hingga yang paling berat merupakan pidana mati.

Untuk itu, sambung dia, sebelum menjatuhkan pidana penjara, hakim bisa mempertimbangkan untuk mengenakan pidana denda, pidana kerja sosial, maupun pidana pengawasan terlebih dahulu.
“Jadi pidana penjara diletakkan paling jauh,” ucap dia.
Wamenkum mengemukakan bahwa KUHP baru menerapkan modifikasi alternatif sanksi pidana, antara lain, bagi pelaku tindak pidana dengan ancaman tidak lebih dari 3 tahun, hakim wajib menjatuhkan pidana kerja sosial.
Indonesia, lanjut dia, belum memiliki pengalaman pidana kerja sosial. Pidana itu pertama kali diberlakukan di Belanda pada tahun 1982.

Dalam pidana kerja sosial, Eddy menyebutkan terdapat aturan kerja sosial tidak dilakukan lebih dari 40 jam dalam seminggu dan tidak mengurangi hak untuk bekerja bagi kepentingan keluarganya.
“Apabila pelaku tindak pidana terancam hukuman lebih dari 5 tahun, hakim wajib menjatuhkan pidana pengawasan atau biasa disebut pidana percobaan,” katanya.(*)
