Jakarta, JURNAL TIPIKOR – Komisi Pemberantasan Korupsi (KPK) menyatakan keyakinannya bahwa Majelis Hakim Pengadilan Negeri Jakarta Pusat akan merujuk pada Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2018 saat menangani permohonan praperadilan yang diajukan oleh buronan kasus dugaan korupsi pengadaan kartu tanda penduduk elektronik (KTP-el), Paulus Tannos alias Thian Po Tjhin.
Juru Bicara KPK, Budi Prasetyo, menegaskan bahwa SEMA tersebut secara jelas melarang tersangka yang berstatus buronan atau masuk dalam Daftar Pencarian Orang (DPO) untuk mengajukan praperadilan.
“Kami meyakini hakim praperadilan akan merujuk pada Surat Edaran Mahkamah Agung Nomor 1 Tahun 2018 yang melarang tersangka berstatus buron mengajukan praperadilan,” ujar Budi Prasetyo kepada jurnalis di Jakarta, Sabtu (29/11/2025).

SEMA No. 1 Tahun 2018 mengatur bahwa tersangka yang melarikan diri atau berstatus DPO tidak dapat mengajukan praperadilan.
Budi menjelaskan bahwa jika permohonan tetap diajukan oleh penasihat hukum atau keluarga, maka hakim wajib menyatakan permohonan tersebut tidak dapat diterima, dan putusan tersebut tidak dapat ditempuh upaya hukum apa pun.
Budi juga mengingatkan bahwa penerbitan SEMA ini bertujuan untuk mencegah upaya gugatan terhadap keabsahan penyidikan oleh pihak-pihak yang secara sengaja melarikan diri dari proses hukum.
“Tidak adil bila seseorang menolak hadir, tidak kooperatif, bahkan melarikan diri, namun tetap ingin mempersoalkan keabsahan penetapan tersangka dan tindakan penyidikan oleh KPK melalui praperadilan. Negara tentu tidak memberikan ruang untuk itu,” katanya.
Budi Prasetyo menambahkan bahwa KPK telah menempuh seluruh prosedur pemanggilan sebelum akhirnya menerbitkan status DPO untuk Paulus Tannos. Saat ini, fokus utama KPK adalah membawa Paulus Tannos kembali ke Indonesia untuk mempertanggungjawabkan perbuatannya di hadapan pengadilan.
“KPK masih terus berkoordinasi dengan otoritas internasional untuk proses pemulangan Paulus Tannos ke Indonesia. Dengan demikian, sebetulnya yang diperlukan saat ini bukan praperadilan, tetapi kehadiran tersangka agar proses hukumnya dapat berjalan efektif,” tutup Budi.
