Jakarta, JURNAL TIPIKOR – Tim kuasa hukum mantan Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi (Mendikbudristek) 2019-2024,
Nadiem Makarim, menyatakan bahwa penetapan tersangka terhadap kliennya oleh Kejaksaan Agung (Kejagung) terkait dugaan korupsi pengadaan laptop Chromebook adalah tidak sah dan tidak mengikat secara hukum.
Kuasa Hukum Nadiem, Dodi S. Abdulkadir, mengungkapkan terdapat tujuh alasan utama yang mendasari klaim tersebut, yang mayoritas berkaitan dengan cacat prosedur dan ketiadaan bukti yang disyaratkan oleh undang-undang.
Tujuh Poin Keberatan Hukum
Dodi S. Abdulkadir merinci tujuh poin yang menurutnya membuat penetapan tersangka Nadiem tidak sah:
- Tidak Ada Audit Kerugian Keuangan Negara Nyata: Penetapan tersangka tidak disertai hasil audit perhitungan kerugian keuangan negara yang bersifat nyata (actual loss) oleh Badan Pemeriksa Keuangan (BPK) maupun Badan Pengawasan Keuangan dan Pembangunan (BPKP). Audit ini merupakan syarat mutlak pemenuhan dua alat bukti dalam kasus korupsi.
- Hasil Audit Internal Justru Bebas Indikasi Kerugian: Audit yang telah dilakukan oleh BPKP dan Inspektorat terhadap Program Bantuan Peralatan TIK 2020-2022 menunjukkan tidak adanya indikasi kerugian keuangan negara akibat perbuatan melawan hukum oleh Nadiem. Fakta ini diperkuat dengan Laporan Keuangan Kemendikbudristek tahun 2019-2022 yang mendapatkan opini Wajar Tanpa Pengecualian (WTP).
- Cacat Prosedur Penetapan Tersangka: Penetapan tersangka dilakukan tanpa minimal dua bukti permulaan yang sah dan tanpa pemeriksaan calon tersangka. Surat penetapan tersangka dikeluarkan pada tanggal yang sama dengan surat perintah penyidikan (4 September 2025).
- SPDP Tidak Diterbitkan/Diterima: Surat Pemberitahuan Dimulainya Penyidikan (SPDP) tidak pernah diterbitkan dan/atau tidak pernah diterima oleh Nadiem, melanggar Pasal 109 KUHAP dan menghilangkan fungsi pengawasan penuntut umum.
- Perbuatan yang Disangkakan Tidak Jelas: Program yang dijadikan dasar penetapan tersangka, yaitu “Program Digitalisasi Pendidikan 2019-2022”, bukanlah nomenklatur resmi dan tidak pernah ada dalam Rencana Pembangunan Jangka Menengah Nasional (RPJMN) 2020-2024 maupun kebijakan resmi Kemendikbudristek. Hal ini membuat perbuatan yang dituduhkan menjadi abstrak.
- Kesalahan Identitas Jabatan: Surat penetapan tersangka mencantumkan status Nadiem sebagai karyawan swasta, padahal yang bersangkutan pada periode 2019-2024 menjabat sebagai Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi.
- Penahanan Tidak Sah: Alasan penahanan Nadiem tidak dibuktikan secara objektif. Nadiem memiliki identitas dan domisili jelas, bersikap kooperatif, dan telah dicekal. Statusnya yang sudah tidak lagi menjabat menteri menghilangkan risiko melarikan diri atau menghilangkan barang bukti.
Langkah Hukum Praperadilan
Sebagai respons atas penetapan tersangka tersebut, tim penasihat hukum Nadiem telah mengajukan permohonan praperadilan di Pengadilan Negeri Jakarta Selatan pada 23 September 2025, yang terdaftar dengan nomor 119/Pid.Pra/2025/PN.Jaksel.
Pengadilan Negeri Jakarta Selatan telah menjadwalkan sidang perdana gugatan praperadilan Nadiem pada Jumat, 3 Oktober 2025.
“Fakta-fakta ini yang perlu diketahui masyarakat untuk memastikan bahwa penegakan hukum dilakukan secara fair, transparan, dan sesuai aturan perundang-undangan yang berlaku,” tutup Dodi S. Abdulkadir.
Kejaksaan Agung sebelumnya telah menyatakan menghormati gugatan praperadilan yang diajukan Nadiem sebagai hak tersangka.
