JAKARTA, JURNAL TIPIKOR – Penetapan pengusaha minyak Muhammad Riza Chalid sebagai tersangka oleh Kejaksaan Agung dalam kasus dugaan korupsi tata kelola minyak mentah dinilai sebagai langkah krusial yang menunjukkan keseriusan pemerintah dalam menegakkan hukum.
Menurut pengamat kebijakan publik dari Universitas Trisakti, Trubus Rahardiansah, langkah ini menandai transisi signifikan dalam paradigma penegakan hukum di Indonesia, khususnya di bawah pemerintahan Presiden Prabowo Subianto.
“Ini adalah momen penting yang menandai transisi serius dalam paradigma penegakan hukum di Indonesia.
Di bawah pemerintahan Presiden Prabowo Subianto, hukum tidak lagi tunduk pada oligarki atau ketakutan terhadap nama besar. No more untouchables (tidak ada lagi yang tak tersentuh),” ujar Trubus dalam keterangannya di Jakarta, Jumat (11/7).
Trubus menganalisis perkembangan kasus ini menggunakan teori jendela kebijakan John W. Kingdon, di mana masalah (buruknya tata kelola migas dan dugaan keterlibatan aktor besar),
kebijakan (reformasi hukum dan penguatan penegakan), serta politik (kehadiran kepala negara dengan keberanian politik tinggi) bertemu pada satu momentum.
Ia menilai, penetapan tersangka terhadap Riza Chalid membuka mata publik mengenai strategi Presiden Prabowo dalam memprioritaskan pemberantasan korupsi di sektor-sektor yang bersinggungan langsung dengan kepentingan publik.
“Prabowo menyadari keberadaan aktor-aktor tertentu yang nyaris untouchables oleh hukum pada akhirnya akan merusak sendi-sendi perekonomian publik, sehingga para koruptor kelas kakap harus diperkarakan untuk memberi efek psikologis jangka panjang,” tambahnya.

Bagi Trubus, penegakan hukum terhadap Riza Chalid lebih dari sekadar individu, melainkan sebuah simbol. Riza Chalid, yang selama beberapa tahun terakhir kerap disebut dalam berbagai isu namun terkesan “kebal hukum,
” kini akhirnya ditetapkan sebagai tersangka. “Ia seperti kebal hukum. Dalam istilah teori kebijakan publik, hal ini mencerminkan policy inertia, yaitu kondisi di mana status quo dipertahankan karena tekanan aktor kuat dan lemahnya insentif perubahan. Namun, era Prabowo menginterupsi stagnasi itu,” jelasnya.
Langkah ini juga dipandang sebagai upaya reformasi hukum oleh kepala negara. Trubus menyoroti bahwa tindakan tegas terhadap aktor kuat seperti Riza Chalid mencerminkan transisi dari closed governance yang dikendalikan oleh elite terpilih menuju open and responsive governance yang berpihak pada akuntabilitas dan kepentingan publik.

Kejaksaan Agung juga diapresiasi karena mengambil pendekatan kebijakan publik yang berorientasi pada hasil, bukan hanya proses. Kejagung dinilai tidak sekadar bertindak prosedural, tetapi juga strategis berbasis data dan audit.
“Saya optimistis langkah ini bukan yang terakhir. Prabowo telah membuka jalan menuju penegakan hukum yang tak pandang bulu.
Penetapan Riza Chalid sebagai tersangka membuktikan bahwa era kekebalan hukum telah selesai dan di sinilah titik balik itu terjadi: ketika hukum berdiri tegak, dan negara akhirnya berani bicara jujur pada dirinya sendiri,” pungkas Trubus.
Sebagai informasi, Kejaksaan Agung pada Kamis (10/7) malam telah menetapkan pengusaha M. Riza Chalid (MRC) bersama delapan orang lainnya sebagai tersangka baru dalam kasus dugaan korupsi tata kelola minyak mentah dan produk kilang pada PT Pertamina Subholding dan Kontraktor Kontrak Kerja Sama (KKKS) tahun 2018–2023.
