Bandung, JURNAL TIPIKOR – Kabar gembira bagi kebebasan berpendapat di ranah digital. Mahkamah Konstitusi (MK) pada hari Selasa, 29 April 2025, mengabulkan dua gugatan yang diajukan terkait dengan Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik (ITE).
Putusan ini secara signifikan memperkuat jaminan kebebasan berekspresi bagi seluruh masyarakat Indonesia dalam berinteraksi di dunia maya.
Dalam amar putusannya, MK menyatakan bahwa beberapa pasal dalam UU ITE sebelumnya berpotensi menimbulkan pembatasan yang tidak proporsional terhadap hak konstitusional warga negara untuk menyampaikan pendapat.
Dengan dikabulkannya gugatan ini, diharapkan tidak ada lagi kekhawatiran berlebihan bagi masyarakat dalam menyampaikan kritik, gagasan, maupun informasi secara daring, selama tetap menjunjung tinggi etika dan norma yang berlaku.
“Putusan Mahkamah Konstitusi ini merupakan langkah maju yang penting dalam menjaga iklim demokrasi yang sehat di era digital,” ujar [Nama Juru Bicara/Pengamat Hukum/Tokoh Masyarakat yang Relevan], menanggapi putusan tersebut.
“Kebebasan berpendapat adalah pilar utama demokrasi, dan ruang digital saat ini menjadi arena penting bagi partisipasi publik.”
Lebih lanjut, putusan MK ini diharapkan dapat memberikan kepastian hukum yang lebih jelas dan mencegah terjadinya kriminalisasi terhadap ekspresi yang sah di dunia maya.
Meskipun demikian, penting untuk diingat bahwa kebebasan berpendapat tetap memiliki batasan dan tidak boleh disalahgunakan untuk menyebarkan ujaran kebencian, disinformasi, atau konten-konten yang melanggar hukum lainnya.
MK menegaskan bahwa putusan ini diambil dengan mempertimbangkan secara matang berbagai aspek hukum dan sosial, serta bertujuan untuk menyeimbangkan antara kebebasan berekspresi dengan perlindungan terhadap hak-hak pihak lain dan ketertiban umum.
Dengan adanya putusan ini, diharapkan masyarakat dapat semakin aktif dan bertanggung jawab dalam memanfaatkan ruang digital untuk menyampaikan ide, berdiskusi, dan berpartisipasi dalam kehidupan berbangsa dan bernegara tanpa rasa takut.
