Dalam Ekspose Pengajuan Penghentian Penuntutan Berdasarkan Keadilan Restoratif dihadiri oleh Wakil Kepala Kejaksaan Tinggi Riau Hendrizal Husin, SH., MH, Asisten Tindak Pidana Umum Kejaksaan Tinggi Riau Martinus, SH dan Kasi Oharda bidang Tindak Pidana Umum Kejaksaan Tinggi Riau Faiz Ahmed Illovi, SH. MH,.
Tersangka yang diajukan penghentian Penuntutan berdasarkan Keadilan Restoratif :
KEJAKSAAN NEGERI BENGKALIS
An. Tersangka MARIA Binti SAILAN (Alm) yang disangka melanggar Pasal 362 jo Pasal 367 Ayat (2) KUHP.
Kasus Posisi :
Bahwa berawal pada hari Rabu tanggal 25 April 2023 sekira pukul 22.00 wib, Tersangka yang sedang berada dirumah di Jalan Rampang Kel. Tanjung Kapal Kec. Rupat Kab. Bengkalis berencana dan berniat untuk mengambil sepeda motor merk Honda Revo X dengan Nomor Polisi BM 5878 DAR milik orang tua Tersangka yaitu saksi MARIA Binti SAILAN (Alm) saat saksi MARIA Binti SAILAN (Alm) sedang tidur. Kemudian pada tanggal 26 April 2023 sekira pukul 01.00 wib, Tersangka secara diam-diam membawa sepeda motor Honda Revo yang diletakkan di dapur rumah. Selanjutnya tanpa seizin dan sepengetahuan saksi MARIA Binti SAILAN (Alm),- Tersangka mengeluarkan sepeda motor tersebut melalui ruang belakang rumah dan Tersangka langsung pergi menuju pelabuhan roro tanjung kapal Rupat.
Bahwa sekira pukul 06.00 wib Tersangka menyeberangi laut dengan kapal roro menuju kota dumai dengan tujuan sepeda motor merk Honda Revo tersebut akan Tersangka jual yang mana hasil penjualan sepeda motor tersebut rencananya akan tersangka gunakan untuk membawa pacar tersangka jalan-jalan. Selanjutnya, pada tanggal 16 Mei 2023 sekira pukul 10.00 wib, Tersangka langsung diamankan oleh Tim Opsnal Polsek Rupat di Toko sinar Dumai Elektronik di Jl. Kelapak Tujuh Kec. Rupat Kab. Bengkalis, selanjutnya Tersangka dan barang bukti dibawa ke kantor polisi untuk pemeriksaan lebih lanjut.

Bahwa terdakwa I SUPARDI Als BANG YUN, terdakwa II JIMMY ROHIM Als JIMMY dan terdakwa III RIO PARMANA PUTRA Als RIO Bin SUPARDI pada Rabu tanggal 07 Juni 2023 sekira pukul 17.50 Wib, bertempat dihalaman rumah para terdakwa dan saksi korban EFENDI Als FENDI Jl. Akasia Ujung Gang Ramin Kec. Pangkalan kerinci Kab. Pelalawan, Berawal dari tumpahan tanki air milik saksi EFENDI Als FENDI yang membuat pekarangan rumah tersangka SUPARDI Als BANG YUN tergenang air, kemudian terjadi pertengkaran mulut antara tersangka I SUPARDI Als BANG YUN dengan saksi EFENDI Als FENDI sehingga tersangka II JIMMY ROHIM Als JIMMY yang merupakan anak dari tersangka I SUPARDI Als BANG YUN ikut emosi dan membantu tersangka I SUPARDI Als BANG YUN yang saat itu sedang memukul saksi EFENDI Als FENDI Bin KAMARUDIN dengan menggunakan tangan hingga mengenai badan saksi EFENDI Als FENDI, yang dilanjutkan dorongan oleh tersangka II JIMMY ROHIM Als JIMMY kepada saksi EFENDI Als FENDI sehingga mengakibatkan saksi EFENDI Als FENDI terjatuh ke tanah, Selanjutnya datang saksi SAPARUDIN Als SAPAR memisahkan antara saksi EFENDI Als FENDI dengan tersangka I SUPARDI Als BANG YUN Bin MANSUR, kemudian tidak berselang waktu lama datang tersangka III RIO PARMANA PUTRA Als RIO Bin SUPARDI sambil marah-marah langsung memukul dengan menggunakan tangan hingga mengenai rusuk kiri saksi EFENDI Als FENDI sebanyak 1 (satu) kali, Selanjutnya tersangka tersangka II JIMMY ROHIM Als JIMMY terpancing kembali emosinya, kemudian memukul mulut dengan menggunakan tangan mengepal saksi EFENDI Als FENDI Bin KAMARUDIN sebanyak 1 (satu) kali sehingga mengakibatkan saksi EFENDI Als FENDI Bin KAMARUDIN mengalami luka. Berdasarkan Visum Et Repertum yang dikeluarkan oleh Rumah Sakit Umum Daerah Selasih pada pokoknya menerangkan Pemeriksaan terhadap An. Efendi yaitu ditemukan pada bibir atas bagian dalam, sisi kanan satu sentimeter dari garis pertengahan depan terdapat luka lecet nol koma satu sentimeter kali nol koma satu sentimeter dan pada bibir atas bagian dalam tepat di garis pertengahan depan tampak luka lecet berwarna kemerahan dengan ukuran nol koma satu setimeter kali nol koma satu sentimeter.

Bahwa pengajuan 2 (dua) perkara untuk dilakukan penghentian penuntutan berdasarkan keadilan Restoratif Justice disetujui oleh Jaksa Agung Muda Tindak Pidana Umum Kejaksaan Agung RI dengan pertimbangan telah memenuhi Pasal 5 Peraturan Kejaksaan Republik Indonesia Nomor : 15 Tahun 2020 dan Surat Edaran Jampidum Nomor : 01/E/EJP/02/2022 Tanggal 10 Februari 2022 tentang Pelaksanaan Penghentian Penuntutan Berdasarkan Keadilan Restoratif sebagai perwujudan kepastian hukum.
Alasan pemberian penghentian Penuntutan Berdasarkan Keadilan Restoratif ini diberikan yaitu :
1. Telah dilaksanakan proses perdamaian dimana tersangka telah meminta maaf kepada korban dan korban sudah memberikan maaf kepada tersangka;
2. Tersangka belum pernah dihukum;
3. Tersangka baru pertama kali melakukan perbuatan pidana;
4. Ancaman pidana denda atau pidana penjara tidak lebih dari 5 tahun;
5. Tersangka berjanji tidak akan mengulangi perbuatannya;
6. Proses perdamaian dilakukan secara sukarela (tanpa syarat) dimana kedua belah pihak sudah saling memaafkan dan tersangka berjanji tidak mengulangi perbuatannya dan korban tidak ingin perkaranya dilanjutkan ke persidangan;
7. Masyarakat merespon positif penghentian penuntutan berdasarkan keadilan restoratif.
Selanjutnya Kepala Kejaksaan Negeri Bengkalis dan Kepala Kejaksaan Negeri Pelalawan menerbitkan surat ketetapan penghentian penuntutan (SKP2) berdasarkan keadilan restoratif justice sebagai perwujudan kepastian hukum berdasarkan Peraturan Kejaksaan Republik Indonesia Nomor 15 tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif.
