Kasus Penebangan Pohon Di Jl. Ibrahim Adjie Kota Bandung Lanjut ke Proses Hukum
Bandung, JURNAL TIPIKOR— Tujuan penanaman pohon di lingkungan perkotaan adalah Penghijauan selain sebagai sarana untu melestarikan lingkungan, agar lingkungan kembali asri dan sehat tanpa adanya pencemaran. Dengan adanya penghijauan akan menurunkan suhu suatu tempat. Banyaknya oksigen yang dikeluarkan oleh tumbuhan akan membuat ligkungan lebih segar, teduh, nyaman, dan asri.
Sedangkan manfaat menanam pohon pohon hijau di kota yaitu mampu berkontribusi terhadap umur jalan yang lebih lama karena berkurangnya proses pemuaian dan kontraksi aspal. Selain kemampuannya dalam meningkatkan kadar oksigen bumi, pohon juga mampu menyaring polutan yang terbawa di udara sehingga dapat mengurangi kondisi yang menyebabkan asma
Pohon-pohon yang ditanam itu terus dipelihara dengan baik sehingga dapat memberikan manfaat untuk pelestarian lingkungan dan kehidupan manusia. Pohon-pohon itu berfungsi menjaga ketersediaan air, menjaga ekosistem hutan, dan memberikan oksigen.
Menebang pohon sembarangan berarti melakukan aktivitas penebangan pohon, tanpa memperhatikan faktor lain, seperti lingkungan dan makhluk hidup
Ironis sekali dengan realitas yang terjadi di Kota Bandung, Kasus penebangan Pohon liar terjadi kembali di Jl. Ibrahim Adjie No 388 Kota Bandung, kasus penebangan di Kota Bandung seakan tidak ada efek jeranya dengan kejadian-kejadian sebelumnya, padahal payung hukum untuk melindungi keberadaan Pohon di Kota Bandung sudah Berlaku lama, yakni Perda no 9 tahun 2019 yang berbunyi “Bagi pelanggar yang menebang pohon sampai diameter 20 cm kena biaya paksa Ro 10 juta, sedangkan untuk diatas 20 cm terkena pidana ringan, dengan ancaman kurungan 3 bulan dan denda paling banyak Rp 50 juta”.
Tim Jurnal Tipikor sudah melakukan Investigasi kasusnya, mulai terjadi penebangan pohon sampai dengan adanya penyegelan oleh Dinas Satpol PP Kota Bandung,
Ketika Segel dilokasi penebangan sudah dilepas kembali, menimbulkan tanda tanya besar ada apa gerangan yang terjadi, sehingga Tim mulai melakukan investigasi lebih lanjut ke Dinas terkait.
Dari keterangan yang diperoleh dari Mujahid selaku kasi Sidiktindak Satpol Polisi Pamong Praja (Satpol PP) Kota Bandung, Jl. R.A.A. Marta Negara No.4, Turangga, Kec. Lengkong, Kota Bandung, Kamis (27/4).
Pemkot Bandung Terus Berupaya Atasi masalah Sampah Pasca Idul Fitri
Mujahid mengatakan, dalam Kasus Penebangan Pohon yang berjumlah tiga pohon, untuk sanksi satu Pohon pihak Toko Besi Bandung Juara sudah membayar Denda, makanya segel kita lepas sedangkan dua pohon lagi ditindaklanjuti melalui proses hukum yang akan digelar dalam minggu ini, tuturnya
Tim Jurnal Tipikor pasca kejadian kasus penebangan tersebut konfirmasi ke DPKP3 Kota Bandung melalui Nomor Watchapp sekdisnya, dan mendapat arahan untuk konfirmasi ke UPT DPKP3 di Jl. Pasir Luyu Kota Bandung.
Pada hari Jumat, 14 April 2023, Tim Jurnal Tipikor mendatangi Kantor UPT DPKP3 dan bertemu denga Asep selaku Kepala Sub. TU, Dalam keterangan disampaikan penebangan pohon yang di lakukan oleh Toko Besi Bandung Juara tanpa sepengetahuan apalagi Ijin dari UPT DKP3.
Asep menambahkan, dari penebangan ketiga pohon tersebut, kami tidak tahu kemana pohon dan daunya dibuang, padahal pohon tersebut sudah cukup besar dan rimbun, kalau dikatakan kecewa, kami sangat kecewa sekali karena sejak tahun 2006 kami tanam di lokasi tersebut,” Ungkap Asep dengan Nada kecewa.

Ditempat terpisah, Sekjend Badan Pemantau Kebijakan Publik (BPKP) Dadang Dzamaludin, SE memyoroti kasus penebangan liar yan dilakukan oleh Toko Besi Bandung Juara, menurutnya ada pelanggaran yang terjadi dalam penebangan tersebut, yakni pelanggaran terhadap Perda No 9 Tahun 2019 yang berbunyi “Bagi pelanggar yang menebang pohon sampai diameter 20 cm kena biaya paksa Ro 10 juta, sedangkan untuk diatas 20 cm terkena pidana ringan, dengan ancaman kurungan 3 bulan dan denda paling banyak Rp 50 juta.
” Terlebih lagi dalam penebangan tersebut, bekas penebangannya tidak tahu dibuang kemana, jelas ini terjadi pelanggaran berat dan sudah masuk ranah pidana,” ujar Dadang
Lebih lanjut Dadang mengatakan, Peraturan Daerah (Perda) dibuat, dirumuskan bahkan disyahkan menjadi Peraturan Daerah melalui proses jangka waktu yang cukup panjang dan menelan Anggaran Daerah yang nilainya cukup lumayan juga, jadi ketika Perda tersebut sudah disyahkan maka Wajib hukumnya bagi sipapun untuk Masyarakat Kota Bandung serta pihak aparatur Daerah untuk mentaati dn menjalankannya tanpa kecuali, tegasnya

Jadi untuk kasus Penebangan yang terjadi di Jl. H. Ibrahim Adjie oleh Toko Besi Bandung Juara tentunya menjadi perhatian khusus kami LSM. Badan Pemantau Kebijakan Publik (BPKP), yang jelas kami akan mengawal kasusnya.
