Tuduhan Lemah, Pengacara Tiga Tersangka Kasus Hibah Pramuka Bandung Sebut Honor Representatif Sah dalam Mekanisme Regulasi
BANDUNG, JURNAL TIPIKOR — Kuasa hukum tiga tersangka, Eddy Marwoto (EM), Dodi Ridwansyah (DR), dan Deni Nurhadiana Hadimin (DNH), dalam kasus dugaan korupsi dana hibah Kwartir Cabang (Kwarcab) Gerakan Pramuka Kota Bandung, menyatakan bahwa tuduhan yang dialamatkan kepada kliennya lemah secara hukum. Pihak kuasa hukum menilai honor representatif yang diterima para pengurus merupakan bagian dari mekanisme yang diizinkan dalam regulasi.
Rizki Dris Muliyana, salah satu kuasa hukum, menjelaskan bahwa pandangan penyidik yang menganggap honor tersebut bersifat melawan hukum bertentangan dengan kekosongan regulasi yang jelas.
”Kita beranggapan bahwa ada asas yang sebetulnya diperbolehkan dalam aturan mekanisme untuk representatif honor pengurus. Namun pandangan penyidik honor ini dianggap bersifat melawan hukum. Padahal, tidak diatur secara jelas di dalam Permendagri itu tentang tata kelola keuangan daerah apakah representatif honor diperbolehkan atau tidak,” kata Rizki di Bandung, Rabu (25/6/2025).
Menurut Rizki, kekosongan hukum ini akan menjadi landasan utama pembelaan dalam persidangan, dengan fokus bahwa perumusan delik harus secara tegas menyebutkan unsur melawan hukum.
Lebih lanjut, Rizki juga menyoroti klaim Kejaksaan Tinggi Jawa Barat (Kejati Jabar) mengenai kerugian negara sebesar Rp 1,5 miliar dari total hibah Rp 6,5 miliar. Hingga saat ini, pihak kuasa hukum menegaskan bahwa belum ada pernyataan resmi dari lembaga audit yang berwenang yang menguatkan angka kerugian tersebut.
“Sampai detik ini belum ada pernyataan BPKP (Badan Pengawas Keuangan dan Pembangunan) maupun dari APIP (Aparat Pengawasan Intern Pemerintah) menyatakan bahwa ada kerugian negara,” tegas Rizki, seraya menambahkan bahwa pemeriksaan sebelumnya hanyalah sampling, bukan audit investigatif.

Sementara itu, pengacara lain, Ibnu Gifari, menambahkan bahwa perkara ini memiliki keunikan karena menyangkut organisasi Gerakan Pramuka yang mendapatkan hibah melalui permohonan yang sah. Proposal pengajuan hibah, yang mencantumkan honor representatif pengurus sejak awal, telah dievaluasi dan disetujui.
”Proposal ini sudah dievaluasi dan akhirnya hibahnya cair. Kalau dari awal bermasalah, mengapa sampai lolos saat pengajuan proposal. Kami akan fokus ke sana, sifatnya melawan hukum atau tidak. Apakah penggunaan honor representatif itu melawan hukum atau tidak,” tutup Ibnu.
Pihak kuasa hukum siap menghadapi proses persidangan dan membuktikan bahwa tindakan kliennya tidak memiliki unsur melawan hukum.
