BANDUNG, JURNAL TIPIKOR – Tim Penyidik Bidang Tindak Pidana Khusus (Pidsus) Kejaksaan Tinggi Jawa Barat (Kejati Jabar) pada Kamis, 12 Juni 2025, secara resmi menetapkan empat tersangka dalam kasus dugaan tindak pidana korupsi dana hibah dari Pemerintah Kota Bandung kepada Kwartir Cabang (Kwarcab) Gerakan Pramuka Kota Bandung Tahun Anggaran 2017, 2018, dan 2020
Berdasarkan Surat Perintah Penyidikan Kepala Kejaksaan Tinggi Jawa Barat Nomor: Print-1355/M.2/Fd.2/06/2025 tanggal 12 Juni 2025, keempat tersangka yang telah menjalani pemeriksaan selama kurang lebih enam jam tersebut adalah:
- D.N.H., yang saat itu menjabat sebagai Ketua Harian Kwarcab Gerakan Pramuka Pemkot Bandung tahun 2017 dan 2018, serta Wakil Ketua Bidang Organisasi dan Hukum tahun 2017 dan 2018. Penetapan tersangka berdasarkan Surat Kejati Jabar Nomor: TAP-40/M.2/Fd.2/06/2025 tanggal 12 Juni 2025.
- D.R., yang saat itu menjabat sebagai Kepala Dinas Pemuda dan Olahraga (Kadispora) Kota Bandung tahun 2017 dan 2018, serta Wakil Ketua Bidang Hubungan Antar Lembaga Kerjasama Kemitraan pada Kwarcab Kota Bandung sejak tahun 2016 hingga 2019. Penetapan tersangka berdasarkan Surat Kejati Jabar Nomor: TAP-41/M.2/Fd.2/06/2025 tanggal 12 Juni 2025.
- E.M., yang saat itu menjabat sebagai Kadispora Kota Bandung/Ketua Harian Kwarcab Gerakan Pramuka Kota Bandung tahun 2020, serta Wakil Ketua Bidang Organisasi dan Hukum tahun 2020.
- Penetapan tersangka berdasarkan Surat Kejati Jabar Nomor: TAP-42/M.2/Fd.2/06/2025 tanggal 12 Juni 2025.
- Y.I., yang saat itu menjabat sebagai Ketua Kwarcab Gerakan Pramuka Kota Bandung Periode Tahun 2016 s/d Tahun 2021, serta Sekretaris Daerah (Sekda) Kota Bandung periode Tahun 2013 s/d Tahun 2018. Penetapan tersangka berdasarkan Surat Kejati Jabar Nomor: TAP-41/M.2/Fd.2/06/2025 tanggal 12 Juni 2025.

Menyusul penetapan ini, tiga dari empat tersangka, yaitu D.N.H., D.R., dan E.M., langsung dilakukan penahanan. Mereka akan ditahan di Rumah Tahanan Negara Kelas I Bandung selama 20 hari, terhitung sejak 12 Juni 2025 hingga 1 Juli 2025, berdasarkan Surat Penahanan Kepala Kejaksaan Tinggi Jawa Barat Nomor: Print-1357/M.2.5/Fd.2/06/2025, Print-1358/M.2.5/Fd.2/06/2025, dan Print-1359/M.2.5/Fd.2/06/2025 tanggal 12 Juni 2025.
Khusus untuk tersangka Y.I., penahanan tidak dilakukan dalam perkara ini karena yang bersangkutan saat ini sedang menjalani penahanan dalam perkara lain, yakni Tindak Pidana Korupsi terkait Kebun Binatang Bandung.

Kasus ini terungkap setelah penyidikan menemukan fakta bahwa pemberian dana hibah dari Pemerintah Kota Bandung kepada Kwarcab Gerakan Pramuka Kota Bandung pada tahun 2017, 2018, dan 2020 telah mengakibatkan kerugian keuangan negara lebih dari 20% dari total dana hibah yang diterima. Diketahui, Kwarcab Gerakan Pramuka Kota Bandung menerima dana hibah sebesar Rp 6,5 Miliar pada periode tersebut.
Modus operandi yang terungkap adalah kesepakatan antara tersangka Y.I. dan tersangka D.R. pada saat pengajuan proposal dana hibah untuk tahun 2017 dan 2018. Mereka menyetujui pengalokasian biaya representatif bagi para pengurus Kwarcab Gerakan Pramuka Kota Bandung serta honorarium staf Kwarcab, padahal kedua jenis biaya tersebut tidak diatur dalam Keputusan Walikota Bandung yang mengatur tentang Standarisasi Harga Tertinggi Satuan Barang/Jasa di Lingkungan Pemkot Bandung.
Atas perbuatan mereka, keempat tersangka diduga melanggar Pasal 2 ayat 1, Pasal 3 jo Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan atas Undang-Undang No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo Pasal 55 ayat (1) ke-1 KUHP.
Pihak Kejaksaan Tinggi Jawa Barat berkomitmen untuk terus mengusut tuntas kasus ini guna memulihkan kerugian keuangan negara dan menegakkan supremasi hukum.
