Makassar, JURNAL TIPIKOR – Majelis Hakim Pengadilan Negeri (PN) Kelas I A Makassar menjatuhkan vonis bersalah kepada seorang terdakwa pemilik dan pengedar kosmetik berbahaya yang mengandung merkuri, Mustadir Daeng Sila, dengan hukuman 18 bulan penjara dan denda senilai Rp1 miliar.
Vonis tersebut dibacakan oleh Hakim Ketua Angeliky Handajani Day di Ruang Sidang Mudjono PN Makassar, Sulawesi Selatan, pada Selasa.
“Terdakwa terbukti secara sah dan meyakinkan melanggar dakwaan. Oleh karena itu maka dijatuhi hukuman pidana satu tahun enam bulan (18 bulan),” ujar Hakim Ketua Angeliky Handajani Day saat membacakan putusan.

Selain pidana penjara, Mustadir Daeng Sila, yang juga menjabat sebagai Direktur CV Fenny Frans, dijatuhi hukuman tambahan berupa denda sebesar Rp1 miliar. Apabila denda tersebut tidak dibayarkan, terdakwa akan dikenakan subsider dua bulan penjara.
Dalam amar putusannya, majelis hakim menyatakan bahwa Direktur CV Fenny Frans terbukti melanggar Pasal 62 ayat 1 juncto Pasal 8 ayat 1 huruf a Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.
