Jakarta, JURNAL TIPIKOR- Anggota Komisi III DPR RI Abdullah meminta penegak hukum untuk mengusut tuntas kasus pemasangan pagar laut yang dianggap telah melanggar banyak undang-undang.
“Ingat, Indonesia ini negara hukum, bukan negara kekuasaan. Para pakar dan berbagai lapisan masyarakat yang mempertanyakan penegakan hukum kepada tersangka atau yang diduga bersalah adalah peringatan dini dari mereka terkait kepercayaan pada penegakan hukum,” ujar Abdullah dalam siaran pers yang diterima ANTARA di Jakarta, Rabu.
Menurut Abdullah, pemilik pagar laut di Tangerang, Banten terdiri dari perusahaan dan pribadi. PT Agung Intan Makmur diketahui memiliki sertifikat Hak Guna Bangunan (HGB) sebanyak 234 bidang, lalu PT Cahaya Inti Sentosa sebanyak 20 bidang dan sembilan orang mempunyai Sertifikat Hak Milik (SHM) sebanyak 17 bidang. Total jumlah pagar laut yang memiliki sertifikat HGB sebanyak 263 bidang.

Sertifikat pagar laut tersebut dinilai bermasalah karena berpotensi melanggar beberapa peraturan diantaranya UU Tentang KUHP, UU Tentang Pokok Agraria, UU Tentang Perlindungan dan Pengelolaan Lingkungan Hidup, UU Tentang Kelautan, UU Tentang Sumber Daya Air, UU Tentang Ciptakerja dan UU Tentang Tindak Pidana Korupsi.
Dia melanjutkan, penegakan hukum dengan menetapkan tersangka atas kasus pagar laut menjadi hal yang harus dilakukan aparat saat ini, mengingat pemasangan pagar tersebut menimbulkan korban yakni kerusakan alam.
Tidak hanya itu, para nelayan yang umumnya mencari nafkah di laut sekitar lokasi juga terhambat dalam mencari mata pencahariannya.

Abdullah yang juga dari fraksi PKB ini melanjutkan, Ombudsman RI telah merinci data kerugian yang ditimbulkan akibat pemasangan pagar laut.
Data Ombudsman yang dimiliki Abdullah mencatat kerugian per tahun mencapai Rp116,91 miliar per tahun. Rinciannya mulai dari penurunan pendapatan nelayan sebesar Rp93,31 miliar per tahun, kemudian peningkatan biaya operasional sebesar Rp18,60 miliar per tahun dan kerusakan ekosistem laut sebesar Rp5 miliar per tahun.
Ditambah lagi adanya warga Desa Kohod yang melaporkan dugaan masalah pencatutan namanya dalam sertifikat HGB ke Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional (ATR/BPN).
“Ini saya khawatir dengan anggapan banyak pihak yang menilai negara kalah dengan oligarki. Ini akan memunculkan stigma, kalau punya kuasa politik dan bisnis, melanggar aturan akan aman saja. Tidak dapat dibenarkan hal ini,” tegas dia.
Karenanya, untuk menuntaskan permasalahan pagar laut, dia meminta seluruh pihak, termasuk penegak hukum untuk berkolaborasi dalam mengusut aktor-aktor dibalik pemasangan pagar laut ini.

Dia juga berharap agar hukum ditegakkan secara adil demi menunjukkan bahwa Indonesia merupakan negara yang taat akan konstitusi.
“Ini sebagai bentuk dukungan terhadap misi bidang hukum Presiden Prabowo yaitu memperkuat reformasi politik, hukum dan birokrasi, serta memperkuat pencegahan dan pemberantasan korupsi,” jelas dia.(*)
