JURNAL TIPIKOR – Direktur PT Sariwiguna Bina Sentosa (SBS) yang merupakan terdakwa kasus timah, Robert Indarto menyatakan akan mengajukan upaya banding atas putusan Majelis Hakim Pengadilan Tipikor Pengadilan Negeri Jakarta Pusat.
Penasihat hukum Robert Indarto, Handika Honggowongso dalam keterangan yang diterima di Jakarta, Selasa, mengatakan bahwa putusan pidana penjara 8 tahun dan membayar uang pengganti sebesar Rp1,92 triliun yang dijatuhkan kepada kliennya, adalah putusan yang sangat berat.
Ia mengungkapkan bahwa kliennya tidak akan bisa membayar uang pengganti yang dinilai tidak wajar.
“Sampai jual celana kolor pun, Pak Robert Indarto tidak akan bisa melunasi uang pengganti itu,” ucapnya.

Handika juga memastikan bahwa kliennya tidak menikmati hasil senilai Rp1,92 triliun dari kasus korupsi pengelolaan tata niaga komoditas timah di wilayah izin usaha pertambangan (IUP) PT Timah Tbk. pada tahun 2015—2022 itu.
“Uang sebesar itu benar-benar tidak dinikmati oleh Robert Indarto,” ucapnya.
Dia pun berharap banding yang akan mereka ajukan bisa memberikan keadilan.
“Mudah-mudahan di tingkat banding, kami akan mendapatkan keadilan sesuai fakta yang terungkap di persidangan,” ucapnya.

Diketahui, Robert Indarto dijatuhi pidana penjara 8 tahun dan denda sebesar Rp1 miliar subsider pidana kurungan selama 6 bulan serta pidana tambahan berupa pembayaran uang pengganti sebesar Rp1,92 triliun.
“Menyatakan para terdakwa terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana korupsi dan TPPU secara bersama-sama,” kata Hakim Ketua Eko Aryanto dalam sidang yang digelar pada Senin (23/12).
Sebelumnya, Robert dituntut pidana penjara selama 14 tahun, pidana denda Rp1 miliar subsider pidana kurungan selama 1 tahun, serta pidana tambahan berupa pembayaran uang pengganti sebesar Rp1,92 triliun subsider 8 tahun penjara.(*)
