Diketahui, Toni Tamsil alias Akhi yang menjadi terdakwa obstruction of justice atau perintangan penyidikan perkara dugaan tindak pidana korupsi tata niaga timah wilayah Izin Usaha Pertambangan (IUP) PT Timah Tbk tahun 2015 hingga 2022, telah menjalani sidang putusan pada Kamis, 29 Agustus 2024.
Dikutip dari laman Sistem Informasi Penelusuran Perkara (SIPP) Pengadilan Negeri Pangkalpinang, majelis hakim menjatuhkan pidana penjara selama tiga tahun kepada Toni.
Pidana tersebut dijatuhkan karena Toni telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana dengan sengaja merintangi penyidikan perkara korupsi.
Putusan lainnya yang dijatuhkan adalah menetapkan masa penahanan yang telah dijalani terdakwa dikurangkan seluruhnya dari pidana yang dijatuhkan, menetapkan terdakwa tetap ditahan, dan membebankan kepada terdakwa untuk membayar biaya perkara sejumlah Rp5.000.
Putusan pidana penjara tiga tahun itu lebih ringan dari tuntutan JPU yang meminta agar Toni dijatuhi pidana penjara tiga tahun dan enam bulan serta pidana denda sebesar Rp200 ribu dengan ketentuan apabila denda tersebut tidak dibayar, diganti dengan pidana kurungan selama tiga bulan.
Selain itu, JPU juga menuntut agar majelis hakim membebankan biaya perkara kepada terdakwa sebesar Rp10.000.
