BANDUNG, JURNAL TIPIKOR – Ketua Umum Badan Pemantau Kebijakan Publik (BPKP), A. Tarmizi, menentang keras dan mengeluarkan peringatan keras terhadap rencana atau keputusan penunjukan kembali seorang yang telah memasuki usia pensiun untuk menjabat sebagai Pelaksana Tugas (PLT) Direktur Utama Perusahaan Umum Daerah (Perumda) Tirtawening.
Tindakan ini, menurut BPKP, secara jelas diduga kuat menyalahi kaidah hukum dan prinsip Tata Kelola Perusahaan yang Baik (Good Corporate Governance) yang berlaku pada Badan Usaha Milik Daerah (BUMD).
A. Tarmizi menegaskan bahwa penunjukan kembali figur yang sudah pensiun sebagai PLT Dirut untuk masa tugas berikutnya merupakan preseden buruk dan berpotensi melanggar ketentuan batas usia maksimal jabatan Direksi BUMD.
Analisis Hukum BPKP: Pelanggaran Batas Usia dan Ketidaktepatan Status
Berdasarkan kajian dan analisis hukum BPKP yang mengacu pada
Undang-Undang Nomor 23 Tahun 2024 Pasal 33, Peraturan Pemerintah (PP) Nomor 54 Tahun 2017, dan Peraturan Menteri Dalam Negeri (Permendagri) Nomor 37 Tahun 2018, BPKP menemukan setidaknya dua poin krusial yang dilanggar:
1. Potensi Pelanggaran Batas Usia Jabatan
- Aturan Tegas: PP 54/2017 dan Permendagri 37/2018 (Pasal 50 Ayat (1) huruf i) mensyaratkan calon anggota Direksi harus berusia paling tinggi 55 (lima puluh lima) tahun pada saat mendaftar pertama kali.
- Logika Hukum PLT: Meskipun PLT bersifat sementara, fungsinya adalah menjalankan tugas Dirut definitif. “Jika seseorang telah pensiun, ia secara otomatis sudah melewati batas usia maksimal untuk menjabat Direksi. Mengangkatnya sebagai PLT sama saja dengan mengabaikan semangat regenerasi dan persyaratan kompetensi/usia yang diamanatkan regulasi,” tegas A. Tarmizi.
2. Ketidaktepatan Status Kepegawaian PLT
- Status Pensiun: Jabatan Direksi BUMD mensyaratkan keaktifan dan kapasitas prima. Individu yang sudah pensiun telah gugur dari status sebagai pejabat atau pegawai aktif, baik Perumda maupun PNS.
- Fungsi PLT: Penunjukan PLT idealnya diambil dari pejabat atau pegawai internal yang masih aktif dan memenuhi syarat untuk menjamin kelancaran operasional sementara, bukan dari individu yang status kepegawaiannya sudah berakhir.
“Kepala Daerah selaku Kuasa Pemilik Modal (KPM) harusnya menunjuk PLT dari pejabat internal yang aktif dan qualified, atau segera mempercepat proses seleksi Dirut definitif. Masa jabatan PLT itu darurat administratif, bukan peluang untuk kembali mengangkat eks-pejabat yang sudah pensiun,” ujar A. Tarmizi.
BPKP Tuntut KPM Bertindak Tegas dan Hindari Maladministrasi
A. Tarmizi mendesak Kepala Daerah selaku KPM untuk segera mengevaluasi ulang dan membatalkan rencana atau keputusan penunjukan kembali tersebut. BPKP mengingatkan bahwa tindakan ini tidak hanya rentan secara hukum, tetapi juga merusak citra tata kelola perusahaan publik.
“Kami meminta KPM untuk bertindak tegas dan tidak menimbulkan maladministrasi dalam pengelolaan aset daerah. Jika penunjukan ini tetap dilanjutkan, kami tidak akan segan untuk membawa dugaan penyalahgunaan wewenang ini ke ranah hukum yang lebih tinggi,” tutupnya.
