Bandung, JURNAL TIPIKOR – Pemerintah Kota Bandung telah menerbitkan serangkaian regulasi yang seharusnya menjadi booster bagi peningkatan kinerja Perusahaan Umum Daerah (PERUMDA) Tirtawening.
Namun, di tengah tuntutan publik akan pelayanan air minum dan air limbah yang lebih baik, implementasi regulasi ini terancam gagal karena penyakit kronis dalam tubuh organisasi: kekosongan kewenangan dan tanggung jawab di tingkat Dewan Pengawas (Dewas) dan Direksi.
Dasar Hukum Perbaikan Kinerja yang Belum Terwujud
Penerbitan regulasi di bawah ini merupakan landasan bagi tata kelola BUMD yang lebih profesional dan berorientasi laba:
- PP No. 54 Tahun 2017 tentang Badan Usaha Milik Daerah (BUMD).
- Permendagri No. 23 Tahun 2024 tentang Organ dan Kepegawaian BUMD Air Minum.
- Perda Kota Bandung No. 06 Tahun 2020 tentang Perumda Tirtawening Kota Bandung.
- Perwal Kota Bandung No. 26 Tahun 2022 tentang Tarif Layanan Air Minum dan Air Limbah.
Regulasi-regulasi ini, khususnya yang mengatur organ dan tata kelola, seharusnya menjadi motor penggerak untuk mengakhiri kerugian yang dialami PERUMDA Tirtawening selama beberapa tahun ke belakang.
Potensi Laba yang Terancam Hilang
Sebagai BUMD besar dengan cakupan lebih dari 100.000 sambungan pelanggan, PERUMDA Tirtawening memiliki potensi pendapatan yang signifikan.
Dengan target rasio biaya operasi terhadap pendapatan operasi adalah 0,85%, implementasi regulasi yang profesional dan tata kelola yang baik seharusnya mampu menghasilkan laba minimal 15% per tahun.
Namun, muncul kekhawatiran bahwa laba perusahaan (jika ada) hanya mampu membayar gaji, tantiem, dan bonus pegawai, tanpa alokasi proporsional untuk Dana Cadangan dan Dividen bagi Pemkot Bandung. Padahal, sesuai regulasi, alokasi untuk gaji, tantiem, dan bonus pegawai maksimal hanya 30% dari pendapatan tahun lalu, guna memastikan efisiensi dan produktivitas.
Krisis Organisasi dan Kebijakan KPM yang Disorot
Dewas dan Direksi adalah jantung dan paru-paru perusahaan. Saat ini, kedua organ ini berada dalam kondisi sakit kronis kekosongan kewenangan.
Walikota sebagai Kuasa Pemilik Modal (KPM) memegang peran kunci dalam pengambilan keputusan dan kebijakan, bahkan secara operasional melalui fungsi pengawasan Dewas dan pelaporan Direksi (audit kinerja wajib per tiga bulan).

Ironisnya, alih-alih melakukan mitigasi organisasi yang mendesak, KPM sebagai pengambil keputusan tertinggi dinilai lambat dalam penentuan kepemimpinan baru.
Penunjukan Pejabat Sementara (Plt) Direktur Utama (Dirut) dari unsur internal Pemkot dipertanyakan efektivitasnya untuk memulihkan tata kelola, terutama jika merujuk pada Permendagri No. 6 Tahun 2020 yang mengatur mekanisme penunjukan Plt saat terjadi kekosongan jabatan, yang prioritasnya adalah:
- Opsi 1 (Kosong Dirut): Plt ditunjuk dari Ketua/Anggota Dewas.
- Opsi 2 (Kosong Dewas & Dirut): Plt ditunjuk dari salah satu Direksi.
- Opsi 3 (Kosong Dewas & Direksi): KPM wajib mengangkat pejabat Pemkot minimal tingkat Pratama sebagai Dewas Perumda terlebih dahulu sebelum mendapat penugasan sebagai Plt Dirut selama 6 bulan.
Mendesak: KPM wajib menetapkan susunan Dewas dan Direksi yang baru paling lambat 6 bulan sejak pembentukan Pansel dan penunjukan Plt.
Tanggung Jawab Pemkot Adalah Warga Bandung
Apapun yang terjadi dalam tubu PERUMDA Tirtawening, tanggung jawab Pemkot dalam memberikan pelayanan terbaik kepada warga Kota Bandung tidak boleh diabaikan.
Dengan penyertaan modal daerah, warga Kota Bandung sesungguhnya adalah KPM dan pemilik sejati dari PERUMDA Tirtawening, dan berhak atas pertumbuhan ekonomi dan kesejahteraan dari kinerja BUMD ini.
KPM dituntut untuk segera mengambil langkah urgent dan strategis untuk membenahi organ PERUMDA Tirtawening, memastikan regulasi dilaksanakan secara profesional, dan mengembalikan PERUMDA Tirtawening pada jalur profitabilitas untuk kepentingan publik.
