JAKARTA, JURNAL TIPIKOR – Sebanyak 24 tokoh antikorupsi, yang tergabung dalam Gerakan Pemberantasan Korupsi Berkeadilan, secara resmi mengajukan amicus curiae atau “sahabat pengadilan” ke Mahkamah Konstitusi (MK).
Pengajuan ini berkaitan dengan uji materi (judicial review) terhadap Pasal 2 ayat (1) dan Pasal 3 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (UU Tipikor) sebagaimana telah diubah dengan UU Nomor 20 Tahun 2001.
Dalam konferensi pers di Jakarta, Koordinator Gerakan Pemberantasan Korupsi Berkeadilan, Erry Riyana Hardjapamekas, yang juga mantan Komisioner Komisi Pemberantasan Korupsi (KPK), menyatakan bahwa gerakan ini sepakat mendukung permohonan uji materi tersebut. Menurutnya, pemberantasan korupsi di Indonesia telah “salah arah dan tidak efektif.”
“Korupsi tidak lagi dilihat sebagai perbuatan dengan maksud untuk mendapatkan keuntungan secara tidak sah, namun sebatas pada semua perbuatan yang dipandang merugikan keuangan negara. Ini membuat orang yang beritikad baik, bahkan orang yang menjalankan kewajibannya tanpa menerima suap, bisa menjadi terpidana korupsi,” kata Erry.

Uji materi ini diajukan oleh sejumlah pemohon, termasuk mantan Direktur Utama Perum Perikanan Indonesia Syahril Japarin, mantan pegawai Chevron Indonesia Kukuh Kertasafari, mantan Gubernur Sulawesi Tenggara Nur Alam, serta mantan Direktur Utama Merpati Airlines Hotashi Nababan.
Lebih lanjut, Erry menjelaskan bahwa fokus penegakan hukum pada unsur kerugian negara sering kali tidak nyata dan menggunakan asumsi atau prediksi. Padahal, Pasal 2 dan 3 UU Tipikor seharusnya menekankan pada elemen perbuatan melawan hukum dan penyalahgunaan wewenang untuk mendapatkan keuntungan secara tidak sah.
Senada dengan Erry, ekonom Wijayanto Samirin menyoroti kecenderungan penanganan kasus korupsi yang lebih fokus pada kerugian negara daripada unsur “memperkaya diri secara melawan hukum.”

Ia berpendapat bahwa potensi rugi atau untung adalah konsekuensi dari pengambilan keputusan, terutama dalam konteks bisnis BUMN. “Hal ini mengaburkan esensi korupsi itu sendiri, yaitu perbuatan curang yang bertujuan mendapatkan keuntungan secara tidak sah,” ujarnya.
Sementara itu, Ketua Dewan Pers Komaruddin Hidayat menambahkan bahwa “salah fokus” ini berdampak buruk pada kualitas penegakan hukum, menciptakan ketidakpastian bagi para pejabat sektor publik, dan membuat pencegahan bukan lagi prioritas.
Ia mengatakan, banyak pejabat, termasuk direksi BUMN, menjadi takut mengambil keputusan strategis yang berisiko finansial, meski bertujuan untuk kebaikan publik.
