Jakarta, JURNAL TIPIKOR – Menteri Imigrasi dan Pemasyarakatan (Menimipas) Agus Andrianto hari ini mengonfirmasi bahwa pembebasan bersyarat terpidana korupsi Setya Novanto telah sesuai dengan prosedur hukum yang berlaku.
Keputusan ini diambil setelah Mahkamah Agung (MA) mengabulkan Peninjauan Kembali (PK) yang diajukan oleh Setya Novanto, yang akrab disapa Setnov.
Keputusan Bebas Bersyarat Sesuai Prosedur Hukum
Menteri Agus menjelaskan bahwa pembebasan bersyarat ini didasarkan pada hasil asesmen yang ketat dan putusan PK MA.
“Iya, karena sudah melalui proses asesmen, dan yang bersangkutan berdasarkan hasil pemeriksaan PK itu sudah melampaui waktunya. Harusnya tanggal 25 yang lalu,” ujar Menteri Agus saat ditemui di Istana Merdeka, Jakarta, setelah mengikuti upacara Kemerdekaan RI.
Setya Novanto, mantan Ketua DPR RI, telah menjalani hukuman di Lembaga Pemasyarakatan (Lapas) Sukamiskin, Bandung, Jawa Barat. Ia secara resmi bebas bersyarat pada 16 Agustus 2025.
Tidak Ada Wajib Lapor dan Denda Telah Dibayar
Saat ditanya mengenai kewajiban lapor, Menteri Agus menegaskan bahwa Setya Novanto tidak lagi diwajibkan untuk melakukannya. “Gak ada, karena kan denda subsidier sudah dibayar,” kata Menteri Agus.
Pernyataan ini sejalan dengan putusan PK MA yang memotong vonis Setya Novanto menjadi 12 tahun dan 6 bulan penjara, serta mengubah denda pidana menjadi Rp500 juta. Jika denda ini tidak dibayar, maka akan diganti dengan 6 bulan kurungan.

Putusan PK Mahkamah Agung
Berdasarkan putusan Mahkamah Agung Nomor 32 PK/Pid.Sus/2020 yang diakses pada 2 Juli 2025, permohonan PK Setya Novanto dikabulkan.
Putusan ini juga membebankan uang pengganti sebesar $7.300.000, yang sebagian telah dibayarkan sehingga sisa uang pengganti yang harus dibayar adalah Rp49.052.289.803. Jika uang pengganti tidak dapat dibayar, maka akan diganti dengan 2 tahun penjara.
Selain itu, MA menjatuhkan pidana tambahan berupa pencabutan hak Setya Novanto untuk memegang jabatan publik selama 2 tahun dan 6 bulan. Hukuman tambahan ini akan berlaku setelah ia selesai menjalani masa pidananya.
