Hutan jadi alibi, honor jadi ambisi
JURNAL TIPIKOR — Seharusnya, program Forest and Other Land Use (FOLU) Net Sink 2030 menjadi mercusuar komitmen Indonesia terhadap dunia. Dengan dukungan penuh dari pemerintah Norwegia melalui hibah lingkungan, program ini didesain untuk mengurangi emisi karbon dan memperkuat tata kelola kehutanan.
Namun semua harapan itu berubah haluan di tangan Menteri Lingkungan Hidup dan Kehutanan Raja Juli Antoni. Alih-alih membangun struktur teknokratik, sang menteri justru mengangkat dirinya sendiri sebagai Penanggung Jawab Tim FOLU, dengan honorarium Rp50 juta per bulan yang bersumber dari dana hibah Norwegia.
Tak berhenti di situ, 11 kader Partai Solidaritas Indonesia (PSI), partai tempat sang menteri berasal, ikut diangkat ke dalam struktur. Mereka digaji bulanan antara Rp8 juta hingga Rp25 juta. Hibah Norwegia, yang semula diperuntukkan bagi hutan dan masyarakat adat, kini malah menjadi sumber penghasilan politisi. Pertanyaannya, ini strategi penyelamatan hutan atau strategi penyelamatan partai?
Landasan hukum: dana hibah bukan gaji kader
Secara hukum, penggunaan dana hibah dari luar negeri diatur secara ketat. UU No. 17 tahun 2003 tentang Keuangan Negara menyebut bahwa semua penerimaan negara bukan pajak (termasuk hibah) harus dikelola secara transparan, dilaporkan ke DPR, dan diaudit oleh BPK. Sementara PP No. 10 tahun 2011 menggariskan bahwa honorarium hanya boleh diberikan kepada tenaga ahli teknis yang diseleksi secara terbuka. Lebih jauh, Perpres No. 16 tahun 2018 menyatakan bahwa pengadaan tenaga kerja atau sumber daya manusia dalam program pemerintah harus melalui proses yang terbuka, kompetitif, dan berbasis merit.
Selain itu, Letter of Intent (LoI) antara Norwegia dan Indonesia yang diperbarui pada tahun 2021 secara tegas mengatur bahwa dana hibah hanya boleh digunakan untuk kegiatan berbasis lapangan, seperti restorasi lahan, penguatan masyarakat adat, dan sistem monitoring emisi karbon.
Tidak ada satu klausul pun yang membenarkan penunjukan kader partai tanpa seleksi untuk menerima honor rutin dari dana tersebut.
*Temuan LHP BPK 10 tahun tidak pernah separah ini*
Dalam kurun waktu 2014 hingga 2024, Laporan Hasil Pemeriksaan (LHP) BPK menunjukkan pola penyimpangan dana hibah di Kementerian LHK yang bersifat sistematis dan berulang. Misalnya, pada tahun 2019, ditemukan bahwa alokasi untuk biaya administrasi program REDD+ melebihi 30 persen, padahal dalam LoI Norwegia hanya dibolehkan maksimal 15 persen. Nilai penyimpangannya kala itu mencapai Rp128 miliar.
Tahun 2021, dana hibah sebesar USD 5,2 juta untuk Kabupaten Morowali digunakan untuk pembangunan jalan non-lingkungan dan honorarium tim fiktif, dengan potensi kerugian negara mencapai Rp76 miliar.
Tahun 2022, sekitar 22 persen dana FOLU Net Sink dialihkan untuk honor “tenaga ahli” tanpa bukti kerja di lapangan, senilai Rp90 miliar. Di tahun 2023, BPK menemukan bahwa 7 nama penerima hibah di Kalimantan tidak tercatat dalam database resmi kementerian, kerugian negara ditaksir Rp44 miliar.
Puncaknya, pada tahun 2024, sebesar 40 persen dana yang semestinya untuk masyarakat adat dialihkan ke biaya konsultan dan “penasihat”, dengan nilai penyimpangan mencapai Rp187 miliar.
Ironisnya, dalam seluruh periode ini, BPK telah merekomendasikan audit khusus terhadap dana hibah setiap tahun, namun KLHK hanya melaksanakannya sekali, yaitu pada tahun 2020. Bahkan, dari rekomendasi sanksi terhadap 12 pejabat dalam kasus 2022, hanya tiga orang yang ditindak.
Struktur SK 32/2025 disorot publik bukan karena jumlah, tapi karena motif
Struktur Tim FOLU Net Sink 2030 berdasarkan SK MenLHK No. 32/2025 mencatat nama-nama yang identik dengan kader Partai Solidaritas Indonesia. Mereka adalah Raja Juli Antoni sebagai Penanggung Jawab (Rp50 juta per bulan), Andy Budiman sebagai penasihat (Rp25 juta), tujuh anggota bidang yang masing-masing digaji Rp20 juta, serta tiga staf sekretariat dengan gaji Rp8 juta per bulan. Jumlah honorarium seluruhnya mencapai Rp239 juta per bulan. Semua dibayar menggunakan dana hibah Norwegia melalui Badan Pengelola Dana Lingkungan Hidup (BPDLH).
Yang lebih mengkhawatirkan, LoI Norwegia menetapkan batas maksimal honor setara USD 3.000 per bulan. Honor Raja Juli sendiri mencapai setara USD 3.200 per bulan (Rp50 juta pada kurs Rp15.600), jelas melanggar batas donor. Lebih fatal lagi, jabatan “penasihat ahli” seperti Andy Budiman tidak dikenal dalam struktur teknis hibah dan tidak tercantum dalam dokumen LoI maupun pedoman pengelolaan hibah.
*Kritik taam DPR RI: ini bukan program partai, tapi program negara*
Wakil Ketua Komisi IV DPR RI, Alex Indra Lukman, menyebut bahwa keterlibatan kader PSI dalam struktur tim FOLU sangat mengkhawatirkan. Ia menegaskan bahwa publik berhak tahu siapa yang menyeleksi tim tersebut, dan berdasarkan kriteria apa. Ia bahkan menyebut bahwa komposisi ini bukan hasil seleksi terbuka, tapi hasil seleksi berbasis afiliasi politik. Dalam kata lain, ini bukan tim teknis, tapi tim politik.
Pelanggaran hukum, moral, dan etika jabatan
Penunjukan tim FOLU ini melanggar pasal 11 PP 10/2011 yang mewajibkan seleksi terbuka bagi tenaga ahli penerima hibah. Juga melanggar Perpres 16/2018 yang mewajibkan transparansi pengadaan SDM. Menteri juga berpotensi melanggar UU 17/2003 pasal 35 karena laporan realisasi hibah tahun 2023 dan 2024 belum disampaikan ke DPR. Secara moral, penunjukan diri sendiri sebagai Penanggung Jawab sekaligus pengendali struktur tim adalah bentuk konflik kepentingan yang vulgar. Bahkan dalam konteks UU Tipikor, penerimaan honor dari sumber dana luar negeri tanpa akuntabilitas bisa dikategorikan sebagai gratifikasi atau penyalahgunaan jabatan.
Risiko diplomatik bisa akibatkan ambruk kepercayaan dunia
Donor Norwegia dalam LoI 2021 menyebut bahwa bila lebih dari 30 persen dana dipakai untuk birokrasi, atau bila tim tidak berbasis kualifikasi teknis, mereka berhak menghentikan hibah. Jika audit Norwegia membuktikan adanya penunjukan politis dan tidak transparan, maka komitmen dana sebesar USD 156 juta untuk tahun 2025 bisa dibekukan. Indonesia pun akan kehilangan status sebagai model tata kelola hutan tropis global.
Kenapa Menteri bisa seberani Iiu?
Karena dana hibah dianggap bukan APBN, maka celah pengawasan terbuka lebar. Menteri memanfaatkan kekosongan kontrol untuk melegalkan kaderisasi lewat proyek internasional. Ia menggunakan dalih green economy untuk mendanai loyalis. Di luar terlihat teknokratis, tapi di dalam adalah pola balas budi politik.
Ini bukan semata pelanggaran administratif, tapi transformasi hibah menjadi instrumen kekuasaan. Jika praktik ini dibiarkan, maka seluruh proyek internasional rentan dijadikan ATM politik.
Rekomendasi Indonesian Audit Watch
Pertama, audit independen lintas negara harus segera dilakukan, melibatkan BPK dan auditor Norwegia.
Kedua, SK 32/2025 harus dibekukan dan struktur tim disusun ulang berbasis seleksi terbuka dan kompetensi.
Ketiga, gugatan administratif ke PTUN dapat diajukan karena SK tersebut cacat hukum.
Keempat, DPR RI harus menggunakan hak interpelasi dan hak angket untuk menyelidiki pemanfaatan dana hibah.
Terakhir, PP No. 10/2011 harus direvisi agar penyalahgunaan hibah dapat dipidana.
Penutup
Hibah adalah simbol kepercayaan dunia. Tapi ketika dana itu digunakan untuk menggaji kader partai tanpa kompetensi, maka kita bukan hanya merusak reputasi birokrasi, tapi juga mencederai solidaritas global. Ini bukan sekadar masalah honor, ini masalah martabat bangsa. Jika DPR dan BPK tidak segera bertindak, maka Indonesia akan kehilangan dua hal sekaligus: uang dan kehormatan.
