Wajo, JURNAL TIPIKOR – Pembangunan Jaringan Irigasi DI Gilireng Kiri 1 Kabupaten Wajo yang melekat pada Balai Besar Wilayah Sungai Pompengan Jeneberang (BBWSPJ), disinyalir menggunakan material ilegal.
Proyek yang dikerjakan oleh PT. Karyabangun Sendyko diduga kuat menggunakan material berupa tanah urug berasal dari lokasi yang tidak memiliki izin.
Mengetahui hal tersebut, Ketua Celebes Corruption Watch (CCW) Kabupaten Wajo, Akbar, angkat suara.
Menurutnya, penggunaan tanah ilegal pada suatu proyek merupakan perilaku menyimpang yang dapat mempengaruhi kualitas bangunan serta berpotensi merugikan negara.
” Penggunaan material ilegal tidak memiliki jaminan kualitas dan legalitas, sehingga berpotensi merugikan negara dan penerima manfaat,” ucap, Akbar, kepada ENews Indonesia, Selasa, (08/07/25).

Akbar menilai, pihak pelaksana tidak mematuhi amanat undang- undang yang secara jelas mengatur tentang jasa kontruksi.
” Undang-Undang jasa kontruksi nomor 2 tahun 2017 mengatakan bahwa setiap pekerjaan kontruksi harus menggunakan material yang didatangkan dari Quarry galian C yang memiliki Izin Usaha Produksi (IUP) lengkap,” ujarnya.
Ketua CCW Wajo itu menguraikan, perusahaan pelaksana proyek strategis nasional yang menggunakan material tanah ilegal dapat dikenakan sanksi pidana penjara dan denda, serta sanksi administratif.
” Aturan jelas, sesuai dengan Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara, dapat dikenakan sanksi pidana dapat berupa kurungan penjara hingga 5 tahun dan denda maksimal Rp 100 miliar. Perusahaan juga dapat dikenai sanksi administratif seperti pencabutan izin usaha,” urainya
Selain itu, Pasal 480 KUHP mengatur tentang penadahan, yaitu perbuatan membeli, menyewa, menukar, atau menerima barang yang diketahui atau patut diduga merupakan hasil kejahatan. Jika material galian C ilegal digunakan dalam proyek, pihak yang menggunakan material tersebut dapat dianggap sebagai penadah dan dapat dipidana.

Lebih lanjut, Ketua CCW Wajo itu menegaskan, bahwa Undang – Undang (UU) merupakan aturan main yang mengikat seluruh masyarakat dan menjadi dasar hukum dalam berbagai aspek kehidupan
” Negara kita ini, negara hukum. Ketika UU dilabrak, maka aparat penegak hukum harus bertindak. Artinya, bagi siapapun yang telah melanggar undang-undang, mestinya APH segera bertindak tanpa pandang bulu,” Katanya dengan nada tegas
Sementara, Kepala Dinas Lingkungan Hidup (DLH) Kabupaten Wajo, H. Alamsyah, mengaku telah menurunkan satuan tugas (satgas) di area proyek tersebut.
” Berdasarkan pemantauan lapangan,timbunan tanah urug yang dipakai tidak memiliki izin.” Ucap, Alamsyah, Senin, (07/07/25).
” Kesepakatan bahwa mulai saat ini, perusahaan tidak memakai lagi tanah timbunan yang tidak berizin,sambil mencari tanah timbun yang berizin untuk di gunakan” Sambungnya
Diketahui, Poyek Pembangunan Jaringan Irigasi DI. Gilireng Kiri 1 Kabupaten Wajo, dikerjakan PT. Karyabangun Sendyko, dengan jumlah anggaran berdasarkan penawaran 25 Milyar dari pagu anggaran 32 Milyar.
