Jakarta, JURNAL TIPIKOR– Mahkamah Konstitusi (MK) secara tegas meminta Pemerintah dan Dewan Perwakilan Rakyat (DPR) RI untuk menyajikan bukti konkret terkait bentuk partisipasi publik dalam proses pembentukan Undang-Undang Nomor 3 Tahun 2025 tentang Perubahan atas Undang-Undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia (UU TNI).
Permintaan ini disampaikan dalam sidang pemeriksaan lanjutan uji formal UU TNI yang digelar pada Senin, 23 Juni 2025.
Wakil Ketua MK, Saldi Isra, menekankan bahwa dalam uji formal, bukti dan fakta pada tahap penyusunan suatu undang-undang merupakan salah satu penentu utama putusan Mahkamah.
“Karena ini kan tidak soal keahlian dalam perkara pengujian formil ini, tetapi lebih pada soal bukti dan fakta. Oleh karena itu, yang harus dihadirkan ke kami itu sebetulnya adalah bukti-bukti sehingga kami bisa melihat intinya ada atau tidak hal-hal yang diceritakan tadi,” ujar Saldi Isra setelah

Saldi Isra menambahkan bahwa bukti partisipasi publik dalam pembentukan undang-undang harus ditunjukkan secara konkret. Hal ini didasari prinsip bahwa partisipasi publik wajib dilaksanakan pada setiap tahapan, mulai dari perencanaan, pembahasan, hingga persetujuan.
“Tolong nanti kami diberi penjelasan dan bukti-bukti apa bentuk partisipasi yang dilakukan di tiga tahapan penting itu,” tegas Saldi Isra, menggarisbawahi pentingnya transparansi dan akuntabilitas dalam proses legislasi.
