JURNAL TIPIKOR – Menteri Pertahanan (Menhan), Sjafrie Sjamsoeddin angkat bicara soal Letkol Teddy Indra Wijaya yang menjabat sebagai Sekretaris Kabinet atau Seskab. Status Letkol Teddy merupakan Anggota TNI aktif.
Sjafrie menyebut, jika posisi Letkol Teddy di luar 15 kementerian atau lembaga yang diperbolehkan dijabat prajurit aktif, maka harus pensiun dini.
“Jadi, ada 15. Kemudian, untuk jabatan-jabatan tertentu itu kalau mau ditempatkan, dia mesti pensiun,” kata Sjafrie di Kompleks Parlemen, Senayan, Jakarta Pusat, Selasa, 11 Maret 2025.
Sjafrie kembali menegaskan prajurit TNI aktif harus pensiun jika mengisi jabatan di luar 15 kementerian atau lembaga.
Dia kemudian minta awak media untuk mengecek apakah Teddy masuk ke dalam 15 kementerian atau lembaga itu atau tidak.
“Ya, jadi 15, (di luar itu) dia mesti pensiun. (Letkol Teddy) masuk nggak dalam kategori itu? Kalau di luar kategori itu ya terkena, pensiun dulu baru melanjutkan pekerjaan,” tutur dia.
Sebelumnya, Menhan Sjafrie Sjamsoeddin mengatakan berdasarkan Undang-Undang, prajurit TNI aktif bisa menjabat di 15 kementerian/lembaga. Prajurit TNI tersebut tak perlu mengundurkan diri.
Sjafrie menyampaikan itu saat rapat kerja bersama Komisi I DPR yang membahas revisi UU Nomor 34 Tahun 2004 tentang TNI di Kompleks Parlemen, Senayan, Jakarta, Selasa, 11 Maret 2024
Sjafrie bilang prajurit TNI aktif bisa menduduki jabatan pada kantor yang membidangi Koordinator bidang Politik dan Keamanan Negara, Pertahanan Negara, Sekretaris Militer Presiden, Intelijen Negara, Sandi Negara, Lembaga Ketahanan Nasional.
Kemudian, bisa juga di Dewan Pertahanan Nasional, Search and Rescue (SAR) Nasional, Narkotika Nasional, dan Mahkamah Agung. Lalu, Kelautan dan Perikanan, BNPB, BNPT, Keamanan Laut dan Kejaksaan Agung.
“Dalam UU sudah tercantum 15 institusi yang bisa diduduki oleh prajurit aktif TNI, seperti yang ada dalam UU 34 yang sekarang sedang berlaku,” kata Sjafrie.
Merujuk pernyataan Sjafrie, terdapat penambahan 5 jabatan sipil yang bisa dijabat prajurit TNI, yakni Kelautan dan Perikanan, BNPB, BNPT, Keamanan Laut, dan Kejaksaan Agung.
Sementara dalam Pasal 47 ayat 2 Undang-Undang TNI yang berlaku saat ini hanya ada 10 Kementerian/Lembaga yang bisa dijabat oleh TNI aktif. Adapun 10 lembaga itu koordinator bidang Politik dan Keamanan Negara, Pertahanan Negara, Sekretaris Militer Presiden, Intelijen Negara, Sandi Negara, Lembaga Ketahanan Nasional, Dewan Pertahanan Nasional, Search and Rescue (SAR) Nasional, Narkotika Nasional, dan Mahkamah Agung.
