
Jakarta, JURNAL TIPIKOR – Menteri Hukum (Menkum) Supratman Andi Agtas mengatakan pengembalian aset hasil korupsi (asset recovery) lebih penting daripada sekadar menghukum koruptor.
“Kalau aset recovery-nya bisa, pengembalian kerugian negara itu bisa lebih maksimal, itu jauh lebih baik ketimbang sekadar hanya menghukum,” kata Supratman di Kantor Kementerian Hukum, Jakarta, Senin.
Hal itu disampaikan Supratman menanggapi pernyataan Presiden RI Prabowo Subianto soal pengampunan terhadap koruptor jika mengembalikan hasil korupsi.
Menurut dia, yang terjadi saat ini adalah koruptor dihukum bayar uang pengganti, namun nominalnya masih belum bisa sepenuhnya menutup kerugian negara.

“‘Kan selama ini juga faktanya bahwa negara setelah orang dihukum membayar uang pengganti dan lain-lain sebagainya, tetapi tidak sesuai dengan besaran kerugian negara,” ujar Menkum.
Supratman mengatakan bahwa pernyataan Presiden tidak serta-merta langsung dilaksanakan. Masih ada beberapa hal yang harus dibahas untuk pelaksanaannya.
“Akan tetapi, Presiden sama sekali pasti tidak menganggap bahwa itu bisa dilakukan serta-merta. Nah, karena itu teman-teman bisa nanti menunggu langkah konkret selanjutnya setelah diberi arahan kepada kami,” tuturnya.

Lebih lanjut Menkum mengatakan bahwa mekanisme serupa sudah ada di Kejaksaan Agung, yakni denda damai.
“Denda damai itu untuk seluruh tindak pidana. Meski demikian, peraturan turunannya yang belum, dahulu kami minta disepakati antara pemerintah dan DPR itu cukup peraturan Jaksa Agung. Akan tetapi, sampai sekarang saya tidak tahu apakah peraturan Jaksa Agung itu sudah diselesaikan atau belum,” tuturnya.(Antara)
