JURNAL TIPIKOR – Tiga pejabat Universitas Udayana(Unud) yakni I Nyoman Putra Sastra, I Made Yusnantara dan I Ketut Budiartawan divonis bebas oleh Majelis Hakim Pengadilan Tindak Pidana Korupsi dari perkara dugaan korupsi dana sumbangan pengembangan institusi (SPI).
Dalam amar putusan yang dibacakan di Pengadilan Tindak Pidana Korupsi Denpasar, Kamis, Majelis Hakim Putu Ayu Sudariasih dan anggota Gede Putra Astawa dan Nelson menyatakan para terdakwa tidak terbukti melakukan tindak pidana dalam dakwaan kesatu atau dakwaan kedua.
Adapun ketiga terdakwa didakwa oleh JPU dengan dakwaan pertama, Pasal 12 huruf e jo Pasal 18 ayat 1 huruf a dan b Undang-Undang Republik Indonesia Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dan ditambah dengan UU RI No 20 Tahun 2001 tentang Perubahan atas UU RI No 31 tahun 1999 tentang Pemberantasan Tipikor jo Pasal 55 ayat 1 ke-1 KUHP Jis Pasal 65 ayat (1) KUHP.

Atau kedua, Pasal 9 jo Pasal 18 ayat 1 huruf a dan b UU RI No. 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dan ditambah dengan UU RI No. 20 Tahun 2001 tentang Perubahan atas UU RI No 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo Pasal 55 ayat 1 ke-1 KUHP Jis Pasal 65 ayat (1) KUHP.
“Menjatuhkan putusan membebaskan para terdakwa dari seluruh dakwaan tersebut, dan memerintahkan para terdakwa dibebaskan dari tahanan, dengan memulihkan hak-hak terdakwa dalam kedudukan harkat dan martabatnya,” kata Majelis Hakim.
Terhadap tuntutan JPU yang menyatakan para terdakwa terbukti melakukan perbuatan sebagaimana dalam dakwaan Pasal 12 huruf e UU Tipikor, yaitu terbukti melakukan perbuatan secara melawan hukum memaksa seseorang untuk membayar sejumlah uang, Majelis Hakim mempunyai pendapat yang berbeda.
Hakim menilai tidak terbukti adanya perbuatan para terdakwa secara sengaja dan melawan hukum melakukan pemaksaan kepada mahasiswa yang mendaftar di jalur mandiri.

Mahasiswa yang mendaftar secara sadar telah memilih jalur mandiri di Universitas Udayana yang secara umum telah diketahui pada pokoknya kalau mendaftar jalur mandiri pasti ada uang sumbangan (SPI).
Terhadap putusan hakim tersebut, para terdakwa didampingi penasehat hukumnya langsung menerima. JPU Kejati Bali menyatakan akan mengajukan kasasi terhadap putusan hakim tersebut.
Sebelumnya, tiga pejabat Unud tersebut dituntut berbeda oleh JPU. Terhadap terdakwa Putra Sastra, Jaksa menuntut pidana penjara selama 5 tahun, denda Rp200 juta subsider dua bulan kurungan.
Sedangkan Ketut Budiartawan dan Made Yusnantara dituntut pidana penjara masing-masing selama 4 tahun denda Rp200 juta subsider dua bulan kurungan.
Namun, hakim menilai ketiganya tidak terbukti secara sah dan meyakinkan melakukan tindak pidana sebagaimana yang didakwakan dan dituntut oleh Jaksa Penuntut Umum.(*)
