JURNAL TIPIKOR – Calon anggota Legislatif (incumbent) Sobari dari partai NasDem Kota Cimahi, di duga telah melanggar Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, bahwa pada pasal 1 ayat 36, masa tenang adalah masa yang tidak dapat digunakan untuk melakukan aktivitas kampanye pemilu.
Sobari saat dikonfirmasi dirumahnya di lantai empat menjelaskan, bahwa pihaknya tidak melakukan kampanye, tapi dirinya melakukan bintek untuk para saksi dirinya dirumahnya.
“Juga ibu-ibu yang datang kerumah saya berbondong-bondong ingin mendo’akan saya agar terpilih kembali menjadi anggota dewan,” ucap Sobari di Rumahnya di RW 5 Kelurahan Utama, Minggu (11/2/2024).

Namun hal itu menjadi polemik bagi Sobari setelah terbukti dirinya menyebarkan surat undangan terhadap konstituennya dengan kop surat Rumah Aspirasi Balad Sobari Caleg Periode 2024-2029 Dapil 4 (Kelurahan Cibeber, Utama, Leuwigajah) Anggota DPRD Kota Cimahi fraksi NasDem Periode 2019-2024. Surat Undangan Sosialisasi Kampanye nomor 26/DPC/13/1/2024.undangan tertanggal 10 Februari 2024 dan acara di gelar pada hari Minggu 11 Februari 2024 sekira pukul 13.30 WIB.
Karena berdasarkan tahapan-tahapan Pemilu 2024 dalam Peraturan Komisi Pemilihan Umum (PKPU) Nomor 3 Tahun 2022. bahwa masa tenang Pemilu 2024 akan dimulai pada Minggu, 11 Februari 2024. Masa tenang ini akan berlangsung selama 3 hari, terhitung mulai 11 Februari 2024 hingga Selasa, 13 Februari 2024. Setelah masa tenang, Rabu, 14 Februari 2024, rakyat akan secara bersama-sama memberikan hak suaranya di tempat pemungutan suara (TPS).

Begitupula berdasarkan pasal 278 ayat 2 UU No 7 Tahun 2017 disebutkan bahwa selama masa tenang tersebut, baik pelaksana, peserta, atau tim kampanye dilarang menjanjikan imbalan kepada pemilih untuk, Tidak menggunakan hak pilihnya – Memilih pasangan calon – Memilih partai politik peserta pemilu tertentu – Memilih calon anggota DPR, DPRD Provinsi, dan DPRD Kabupaten/Kota tertentu – Memilih calon anggota DPD tertentu Teruntuk pelaksana, peserta, atau tim kampanye yang melanggarnya, akan dikenakan pidana.
Hukumannya tercantum dengan jelas dalam pasal 523 ayat 2. Padanya tertulis bahwa yang melanggar akan dipidana penjara paling lama empat tahun dan denda paling banyak 48 juta rupiah
Sobari juga menjelaskan bahwa dirinya kedatangan tamu ingin mendo’akan dirinya.
“Kalau saya kedatangan tamu ingin mendo’akan saya apa tidak boleh? Dan apa harus saya usir?,” ucap Sobari.

Namun hal itu setelah diberikan masukan bahwa moment mendo’akan Sobari sebagai anggota DPRD, tidak tepat, karena situasinya dalam massa tenang.
Begitupula menurut salah satu pengurus dan mantan Ketua Bawaslu Kota Cimahi Jusa Puandy dalam pesan WhatsApp pihaknya telah melakukan pengecekan kebenarannya. (Poros Media)
