JURNAL TIPIKOR – Kejaksaan Negeri Wajo pada hari Selasa 06 Februari 2024 sekitar pukul 15.30 bertempat di Kantor Kejaksaan Negeri Wajo, kembali melakukan penetapan tersangka dan penahanan terhadap tiga oknum pegawai BPN Kantah Wajo, dalam kasus korupsi Pengadaan tanah untuk pembangunan jaringan irigasi D. I. Gilireng Kabupaten wajo, di desa sakkoli kecamatan sajoanging Kabupaten wajo tahun anggaran 2021.
Kepala Kejaksaan Negeri Wajo, Andi Usama aHarun, SH, MH, didampingi Kasi Pidsus Andi Trismanto dan Andi Saifullah Kasi Intel Kajari Wajo, kepada awak media, mengatakan hari telah melakukan serangkaian pemeriksaan dan telah melakukan penetapan tersangka dengan inisial AA, BS, MA selaku Tim satgas B yang berdinas di BPN Kantah Wajo, atas kasus Tindak Pidana Korupsi pada Ganti Rugi Pengadaan Tanah Untuk Pembangunan Jaringan Irigasi D.I. Gilireng Kabupaten Wajo di Desa Sakkoli, Kecamatan Sajoanging, Kabupaten Wajo Tahun Anggaran 2021.
” Ketiganya telah ditetapkan sebagai tersangka, 2 diantaranya yakni inisial BS dan MA telah kami tahan hari ini dan dibawa ke Rutan kelas II Sengkang, dan untuk inisial AA sebelumnya telah dilakukan penahanan dalam kasus korupsi lain dan telah ditahan oleh kejaksaan tinggi di makassar.

Disinggung soal peran daripada ke Tiga tersangka tersebut yang merupakan pagawai BPN Wajo.
Andi Usama mengatakan bahwa para tersangka ini merupakan Tim Satgas B dan mereka mempunyai peran dan pengetahuan.

Ketiga tersangka ini di tetapkan berdasarkan Surat Penetapan Kepala Kejaksaan Negeri Wajo Nomor :

06/P.4.19/Fd.1/02/2024, dan
07/P.4.19/Fd.1/02/2024.
Tanggal 06 Februari 2024.
Tersangka AA, BS dan MA disangka melanggar Primair Pasal 2 ayat (1) Jo. Pasal 18 Subsidiar Pasal 3 Jo. Pasal 18 Undang-undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, sebagaimana diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo. Pasal 55 Ayat (1) Ke-1 KUHP.

Adapun alasan dilakukan penahanan terhadap tersangka adalah:
1. Alasan Subyektif (berdasarkan Pasal 21 ayat (1) KUHAP) yaitu Dalam hal kekhwatiran bahwa tersangka akan melarikan diri, merusak barang bukti atau menghilangkan barang bukti dan/atau mengulangi tindak pidana.
2. Alasan obyektif (berdasarkan Pasal 21 ayat (4) huruf a KUHAP) yaitu Tindak pidana itu diancam dengan pidana penjara lima tahun atau lebih.

Diketahui sebelumnya, SH telah menjadi tersangka dan sudah menjalani sidang di Pengadilan Tipikor Makassar, dalam perkara dugaan korupsi pembebasan lahan Bendungan Irigasi Desa Sakkoli. Ia dijerat korupsi setelah terkuak lahan yang diperjualbelikan adalah milik negara.
Jaksa menemukan bukti adanya tindak pidana korupsi pada ganti rugi dalam pengadaan tanah untuk pembangunan jaringan Irigasi Gilireng di Desa Sakkoli, Kecamatan Sajoanging tahun 2021.
Terjadi perbuatan melawan hukum atas penerimaan ganti rugi pengadaan tanah untuk pembangunan jaringan Irigasi Gilireng sebanyak 4 bidang tanah yang merupakan barang milik pemerintah daerah.
Empat bidang tanah tersebut terletak di Dusun Cinaga. Masing-masing seluas 6.534 meter persegi, 2.039 meter persegi, 198 meter persegi, dan 360 meter persegi.Dijelaskan Trismanto, atas perbuatannya, SH dijerat Pasal 2 ayat 1 juncto Pasal 18 Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang Perubahan atas Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi dan primair Pasal 3 Undang-Undang Republik Indonesia Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang.
