Jakarta, JURNAL TIPIKOR – Mantan pejabat Direktorat Jenderal Pajak Kementerian Keuangan Rafael Alun Trisambodo divonis 14 tahun penjara dan denda sebesar Rp500 juta subsider 3 bulan penjara dalam kasus dugaan gratifikasi dan tindak pidana pencucian uang (TPPU).
“Menjatuhkan pidana terhadap terdakwa Rafael Alun Trisambodo dengan pidana penjara selama 14 tahun serta denda sebesar Rp500 juta, jika tidak dibayar diganti dengan pidana penjara selama tiga bulan,” kata Hakim Ketua Suparman Nyompa di Pengadilan Tindak Pidana Korupsi pada Pengadilan Negeri Jakarta Pusat, Jakarta, Senin.
Selain itu, Rafael Alun juga dijatuhi pidana tambahan membayar uang pengganti sebesar Rp10,079 miliar dalam kurun waktu satu bulan pascaputusan berkekuatan hukum tetap, subsider 3 tahun penjara.
“Menetapkan masa penahanan yang tekah dijalani terdakwa dikurangi seluruhnya dari pidana yang dijatuhkan,” sambung hakim Suparman.

Menurut majelis hakim, Rafael Alun terbukti secara sah dan meyakinkan menurut hukum bersalah melakukan tindak pidana korupsi dan TPPU, sebagaimana dakwaan kesatu, kedua, dan ketiga JPU KPK. Dengan demikian, Rafael dinyatakan melanggar seluruh pasal yang didakwakan.
Pertama, Rafael melanggar Pasal 12 B jo Pasal 18 Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor Republik Indonesia Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo Pasal 55 ayat (1) Ke-1 KUHP jo Pasal 64 ayat (1) KUHP.
Kedua, Pasal 3 Ayat (1) huruf a dan c Undang-Undang RI Nomor 15 Tahun 2002 tentang Tindak Pidana Pencucian Uang sebagaimana telah diubah dengan Undang-Undang Nomor 25 Tahun 2003 tentang Perubahan Atas Undang-Undang Nomor 25 Tahun 2002 tentang Tindak Pidana Pencucian Uang jo Pasal 55 ayat (1) Ke-1 KUHP jo Pasal 64 ayat (1) KUHP, sebagaimana dakwaan kedua.
Ketiga, melanggar Pasal 3 Undang-Undang Republik Indonesia Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang jo Pasal 55 ayat (1) ke-1 KUHP jo Pasal 64 ayat (1) KUHP, sebagaimana dakwaan ketiga.
Sidang pembacaan putusan Rafael Alun pada hari ini, Senin, sedianya dijadwalkan pada Kamis (4/1). Akan tetapi, majelis hakim melakukan penundaan karena ketika itu belum rampung memutus perkara dimaksud.
Sebelumnya, Senin (11/12/2023), Rafael Alun Trisambodo dituntut hukuman 14 tahun kurungan penjara serta pidana denda sebesar Rp1 miliar subsider pidana kurungan pengganti selama 6 bulan. Ia juga dituntut membayar uang pengganti sebesar Rp18.994.806.137,00, subsider 3 tahun.
Berdasarkan surat tuntutan, Jaksa Penuntut Umum (JPU) Komisi Pemberantasan Korupsi (KPK) menyebut Rafael Alun Trisambodo bersama istrinya Ernie Meike Torondek menerima gratifikasi sebesar Rp18.994.806.137,00 secara bertahap sejak bulan Mei 2002 hingga Maret 2013.
Selain itu, Rafael Alun juga disebut melakukan penerimaan lain yang berkaitan dengan jabatannya sebagai PNS di Direktorat Jenderal Pajak Kementerian Keuangan dengan total Rp47,7 miliar, 2.098.365 dolar Singapura, 937.900 dolar AS, dan 9.800 euro.
Tidak hanya gratifikasi, jaksa meyakini Rafael Alun melakukan TPPU melalui pembelian sejumlah aset berupa tanah, bangunan, hingga mobil.(*)
