Berdasarkan Kronologi kejadian tim Ditpolair menerima Laporan Informasi (LI) Nomor: LI – 26/VI/2023/Ditpolair Tanggal 24 Juni 2023 tentang adanya dugaan Tindak Pidana Perikanan di wilayah Curug Tangerang, Tim unit 1 Subditgakkum Ditpolair Baharkam Polri bersama KP. Pelatuk – 3013 melakukan penyelidikan terhadap terduga pelaku pengiriman BBL dari Pelabuhan Ratu menuju Curug Tangerang.
“setelah dilakukan pemeriksaan terhadap Mobil Toyota Calya Warna Merah ditemukan BBL sebanyak 100.000 ekor lebih, Kemudian Tim melaksanakan Interograsi Terhadap Terlapor Saudara NH, selanjutnya Tim melakukan Pengembangan Terhadap Rumah Warna Hijau yang diduga sebagai Gudang penyimpanan BBL dan ditemukan BBL 250.000 ekor lebih”tulis Konferensi pers dari Kakopolairud Baharkam Polri pada media Bataminfo.co.id pada, Jumat (01/09)

Selanjutnya tim mengamankan terlapor dan barang bukti ke Mako Ditpolair Korpolairud Baharkam Polri untuk dilakukan pemeriksaan lebih lanjut
Adapun Modus Operandi yang di lakukan oleh Pelaku yaitu penampungan BBL yang berasal dari wilayah Sukabumi Jawa Barat dan sekitaran Pulau Jawa lainnya yang dikemas dengan packing basah, kemudian ditransitkan di sebuah Rumah atau Gudang di wilayah Curug Tangerang untuk diganti dari packing basah menjadi packing kering, selanjutnya dimasukkan ke dalam Koper-koper yang telah disiapkan.
“Adapun Benih Bening Lobster tersebut rencananya akan dikirimkan ke Singapura melalui Bandara Soekarno Hatta dan Barang Bukti yang di temukan sebanyak 350.000 ekor lebih Benih Bening Lobster” Tulis dalam pers rilis resmi tersebut
Selanjutnya barang bukti di temukan 100.000 ekor lebih diangkut menggunakan Mobil Calya Merah, 250.000 ekor lebih diamankan di Gudang, 2 (dua) buah tabung oksigen (3 kg) berikut selang, 1 (satu) buah alat pres plastik untuk packing, 1 (satu) buah Mobil Toyota Calya Warna Merah, 4 (empat) tabung oksigen (48.3 kg), 3 (tiga) Tandon air (1050 ltr), dan 5 bak air (+/- 600 ltr), 1 (satu) set blower.

Adapun potensi kerugian negara yang berhasil diamankan dari kegiatan Illegal Fishing tersebut yaitu sebesar

Selanjutnya pelaku akan di sangkakan pasal tindak pidana Penyelundupan BBL adalah Pasal 92 Jo Pasal 26 ayat (1) Undang-undang RI No. 45 tahun 2009 atas perubahan Undang-Undang RI No. 31 tahun 2004 tentang perikanan sebagaimana telah diubah dalam pasal 27 angka 26 Undang-Undang RI No. 6 tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti UU RI No. 2 Tahun 2022 tentang Cipta Kerja.
Ancaman hukuman “Setiap orang yang dengan sengaja di wilayah pengelolaan perikanan Republik Indonesia melakukan usaha perikanan di bidang penangkapan, pembudidayaan, pengangkutan, pengolahan, dan pemasaran ikan, yang tidak memiliki SIUP sebagaimana dimaksud dalam Pasal 26 ayat (1)”. Dipidana penjara paling lama 8 (delapan) tahun dan denda paling banyak Rp. 1.500.000.000,- (satu miliar lima ratus ribu rupiah)
