Pekanbaru, JURNAL TIPIKOR — Bahwa pada hari Kamis Tanggal 06 Juli 2023 sekira pukul 14.00 Wib bertempat di Ball Room Hotel Grand Central, Kepala Kejaksaan Tinggi Riau Dr. Supardi menghadiri Kegiatan Penandatanganan Nota Kesepahaman dan Perjanjian Kerjasama (MOU) antara Kejaksaan Tinggi Riau dengan PT. Nindya Karya.
Turut hadir dalam kegiatan tersebut Kepala Kejaksaan Tinggi Riau Dr. Supardi, Asisten Perdata dan Tata Usaha Negara Meilinda, SH., MH, Komisaris PT. Nindya Karya Andar Perdana Widiastono,, Arif Iswadi General Manager Divisi EPC, Deka Hardiya VP Legal, Project Manager Nindya Karya di Provinsi Riau, Para Kasi di bidang Perdata dan Tata Usaha Negara dan Para Jaksa Pengacara Negara Kejaksaan Tinggi Riau.
Dalam sambutannya Direktur Pemasaran dan pengembangan PT. Nindya Karya Moehermein Z Chaniago mengucapkan terima kasih kepada seluruh pihak yang telah berkontribusi atas terselenggaranya kegiatan Penandatanganan Perjanjian Kerja Sama antara PT Nindya Karya dengan Kejaksaan Tinggi Riau dalam mengoptimalkan pelaksanaan tugas dan fungsi dari para Pihak dalam menangani permasalahan Hukum Bidang Perdata dan Tata Usaha Negara sehingga diharapkan dapat meningkatkan efektifitas terhadap penanganan dan penyelesaian masalah hukum bidang perdata dan tata usaha negara yang dihadapi oleh PT Nindya Karya.
Selanjutnya Direktur Pemasaran dan pengembangan PT. Nindya Karya Moehermein Z Chaniago menyampaikan dengan adanya penandatanganan Perjanjian Kerja Sama kami berharap, kehadiran dan keberadaan pihak Kejaksaan Tinggi Riau yang senantiasa membantu dan mengingatkan PT Nindya Karya, agar dalam setiap pengambilan putusan yang dipandang cukup strategis, komplek dan rentan akan permasalahan dilakukan secara prudent dan kerja sama ini nantinya dapat meningkatkan optimalisasi kemampuan sumber daya yang dimiliki oleh PT Nindya Karya dilandasi keinginan untuk saling membantu dan memberikan dukungan dalam pelaksanaan tugas dan fungsi masing- masing pihak.
Dalam sambutannya Kepala Kejaksaan Tinggi Riau Dr. Supardi menyampaikan salah satu proses untuk mejaga kesinambungan perusahaan adalah dengan penerapan tata kelola perusahaan yang baik dengan memperhatikan anggaran dasar perusahaan dan peraturan perundang-undangan yang berlaku. Dengan penandatanganan perjanjian kerjasama ini diharapkan kejaksaan melalui jaksa pengacara negara pada bidang perdata dan tata usaha negara dapat memberikan kontribusi positif bagi PT. Nindya Karya, yaitu :
1. Memperkuat tata kelola perusahaan, melalui kegiatan pertimbangan hukum baik itu berupa :
a. Pendampingan Hukum (jasa hukum yang diberikan oleh jpn berupa pendapat hukum secara berkelanjutan atas suatu kegiatan yang diajukan oleh pemohon dan diakhiri dengan kesimpulan atas pemberian pendapat hukum tersebut dalam bentuk berita acara pendampingan hukum);
b. Pendapat Hukum (jasa hukum yang diberikan oleh JPN dalam bentuk tertulis sesuai dengan fakta hukum tentang suatu permasalahan hukum perdata dan tata usaha negara, yang dibuat atas permintaan dan untuk kepentingan negara atau pemerintah).
2. Melalui kegiatan bantuan hukum JPN dapat membantu penyelesaian sengketa-sengketa di bidang perdata dan tata usaha negara terkait proses bisnis yang dihadapi oleh Pt. Nindya Karya dengan pihak lain, baik itu selaku penggugat maupun tergugat, dimana JPN dapat bertindak sebagai kuasa hukum PT. Nindya Karya berdasarkan surat kuasa khusus baik secara non litigasi maupun litigasi.
3. Menjadi konsiliator, mediator atau fasilitator dalam hal terjadi sengketa atau perselisihan antar PT. Nindya Karya dengan Pemerintah, BUMN/BUMD lainnya.
Kami berharap perjanjian kerjasama antara PT. Nindya Karya dengan Kejaksaan Tinggi Riau dapat ditindaklanjuti sebagaimana ruang lingkup perjanjian, dan perjanjian tersebut tidak hanya sekedar acara seremonial saja, tetapi dengan pelaksanaan perjanjian tersebut dapat dilakukan pendekatan pencegahan oleh kejaksaan sebagai upaya memastikan bisnis perusahaan dapat terselenggara melalui praktek yang sehat, terutama dalam rangka mendorong hadirnya tata kelola perusahaan yang baik (good corporate governance).
