Melakukan Pelecehan Seksual, Seorang Pejabat di Papua Barat harus Berurusan dengan Kepolisian
Manokwari, JURNAL TIPIKOR – Lagi-lagi pelecehan dilakukan oleh seorang Pejabat publik, peristiwa tersebut terjadi di Provinsi Papua Barat.
Kasus pelecehannya sudah masuk dalam proses penyidikan Ditreskrimum Polda Papua Barat.
Oknum Pejabat Pemerintah Provinsi Papua Barat berinisial LI yang dilaporkan terkait dugaan tindak pidana pelecehan seksual TPKS, mangkir memenuhi panggilan penyidik Ditreskrimum Polda Papua Barat.
LI dilaporkan ke Sentra Pelayanan Terpadu Kepolisian SPKT Polda Papua Barat oleh seorang perempuan berinisial CR dengan nomor LP/B/100/V/2023/SPKT/Polda PB tanggal 10 Mei 2023 tentang Dugaan Pelecehan Seksual

Penjabat Gubernur Papua Barat Drs Paulus Waterpauw ditemui Wartawan mengatakan, saat ini proses hukum sudah pada tingkatan penyidikan.
“Itu kan masalah personal, tentu akan kita back up, dampingi,” ucap Paulus Waterpauw Sabtu (27/5/2023).
Wakil Direktur Reserse Kriminal Umum (Wadirkrimum) AKBP Robertus A Pandiangan menyebut, setelah peningkatan status dari penyelidikan ke tingkat penyidikan, hingga saat ini LI belum ditetapkan sebagai tersangka.
“Pemeriksaan LI sebagai saksi belum tuntas, (karena) yang bersangkutan masih sakit jadi masih diagendakan lagi pemeriksaan lanjutan sebagai saksi,” kata Wadirkrimum Polda Papua Barat, Minggu (29/5/2023)
Pemeriksaan lanjutan, kata Pandiangan, masih menyesuaikan situasi dan kondisi kesehatan LI.
“Melihat perkembangan kesehatan yang bersangkutan, nanti akan di infokan kembali,” kata AKBP Robertus Pandiangan.
Sebelumnya pada Jumat (19/5/2023) Penyidik Ditreskrimum Polda Papua Barat melakukan gelar perkara berdasarkan hasil pemeriksaan terhadap saksi atau korban dan alat bukti yang diperoleh, bahwa perkara dugaan terjadinya Dugaan Tindak Pidana Kekerasan Seksual dengan korban saudari (CR) yang dilakukan oleh saudara (LI) telah memenuhi unsur.
“Sesuai Undang-undang RI. Nomor 12 tahun 2022 tentang tindak pidana kekerasan seksual atau TPKS dan untuk peningkatan status perkara dapat dinaikkan dari tahap penyelidikan ke Tahap Penyidikan,” ujar Robertus
Pasal yang digunakan sebagaimana dimaksud, Primer Pasal 12 Undang-Undang Nomor 12 Tahun 2022 Jo Pasal 64 Ayat (1) KUHP Subsider Pasal 6 huruf c Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual Jo Pasal 64 Ayat (1) KUHP.
