Koruptor Maju jadi Caleg, ICW Menduga ada Penyelundupan Pasal
JAKARTA, JURNAL TIPIKOR – KPU sudah Menjadwalkan untuk tahapan dan Pelaksanaan Pemilu maupun Pileg di Tahun 2024.
Dilansir Kompas.Com, Pihak Indonesia Corruption Watch (ICW) menduga, ada “penyelundupan pasal” di dalam Peraturan KPU (PKPU) terkait pencalonan anggota legislatif pada Pemilu 2024, baik DPR RI, DPRD provinsi, DPRD kota/kabupaten, maupun DPD RI.
Penyelundupan pasal ini dinilai bertentangan dengan putusan Mahkamah Konstitusi Nomor 87/PUU-XX/2022 dan Nomor 12/PUU-XXI/2023.
Dalam 2 putusan itu, MK menetapkan, eks terpidana dengan ancaman hukuman 5 tahun penjara atau lebih harus menunggu masa jeda minimum 5 tahun setelah bebas murni untuk dapat mencalonkan diri sebagai anggota legislatif.

Ketentuan ini diturunkan dalam PKPU Nomor 10 dan 11 Tahun 2023 tentang pencalegan, tetapi KPU menambah pasal baru yang dianggap menabrak putusan MK itu.
Pasal baru itu mengatur bahwa ketentuan soal masa jeda 5 tahun tadi tak berlaku untuk eks terpidana sebagaimana dimaksud turut divonis pidana tambahan berupa pencabutan hak politik.
Meski pasal ini tak spesifik berkaitan dengan koruptor, tetapi peneliti ICW Kurnia Ramadhana menyebut bahwa pasal ini rawan memudahkan koruptor untuk bisa maju sebagai caleg.
Sebab, jika mereka diancam pasal dengan ancaman bui 5 tahun atau lebih, mereka tak perlu menunggu 5 tahun setelah bebas murni untuk bisa maju sebagai caleg seandainya majelis hakim sempat mencabut hak politiknya .

Terlebih, berdasarkan data yang diolah ICW, 31 koruptor yang divonis tambahan pencabutan hak politik (2021) hanya dicabut hak politiknya selama 3 tahun 5 bulan jika dirata-rata.
Ia mengambil contoh seandainya terpidana korupsi itu bebas murni pada 2020 dan hendak maju sebagai caleg.
“Jika mengikuti logika putusan MK dia harus menunggu masa jeda waktu 5 tahun sehingga yang bersangkutan baru bisa mencalonkan diri sebagai caleg pada 2025,” kata Kurnia dalam jumpa pers, Senin (22/5/2023).
“Namun karena ulah dari KPU, mereka sudah bisa mencalonkan diri per 2023, tidak usah menunggu 5 taun, tapi gunakan saja landasan pidana tambahan pencabutan hak politik,” kata dia.

Kurnia khawatir, pasal ini “menginspirasi” para terdakwa korupsi yang berlatar belakang politik atau mantan pejabat publik untuk berharap agar majelis hakim mencabut hak politiknya.
“Karena sanksinya lebih ringan ketimbang mesti mengikuti putusan MK yang harus melewati masa jeda waktu 5 tahun. Ini logika sederhana yang akan terbangun di alam pikir terpidana korupsi yang berasal dari klaster politik,” kata dia.
“Penyelundupan pasal” ini, menurut dia, perlu dibongkar.
Ketika masih diuji publik pun, dalam draf rancangan PKPU terkait pencalegan yang dimiliki Kompas.com, belum ada pasal terkait pengecualian jeda waktu pada eks terpidana yang divonis pencabutan hak politik.
“Siapa yang mencantumkan pasal ini? Apa argumentasinya? Jika dibahas dalam rapat, tentu masyarakat punya hak menagih mana notulensi rapatnya. Kita ingin lihat komisioner mana yang mengusulkan pencantuman pasal ini, atau justru ada pihak lain (yang mengusulkan pencantuman pasal itu),” kata Kurnia.
Dikonfirmasi Kompas.com pada Senin petang, Koordinator Divisi Teknis Penyelenggaraan Pemilu KPU RI Idham Holik mengaku akan segera memberikan tanggapan terkait ini.
